If the seller is introduced by the name B, and the buyer supposes him to be another person of the same name, and under that impression delivers his written promise to buy of B, the B to whom the writing is delivered is the contractee, if any one is, and, notwithstanding what has been said of the use of proper names, I should suppose a contract would be made. /1/ For it is further to be said that, so far as by one of the terms of a contract the thing promised or the promisee is identified by sight and hearing, that term so far preponderates over all others that it is very rare for the failure of any other element of description to prevent the making of a contract. /2/ The most obvious of seeming exceptions is where the object not in fact so identified, but only its covering or wrapper.
Who from so imminent a prospect of death hath delivered us, and still delivers: in whom we trust also that he will yet deliver us: ye also labouring together for us in prayer, that from many persons thanks may be given on our behalf for the gifts bestowed on us by many.
Jonah also says, chap. 2, 8: They that observe lying vanities forsake their own mercy, i.e., all confidence is vain, except confidence in mercy; mercy delivers us; our own merits, our own efforts, do not. Accordingly, Daniel also prays, 9, 18 sq.: For we do not present our supplications before Thee for our righteousnesses but for Thy great mercies.
My Armenian "manager " now delivers me into the hands of one of his compatriots, from whom I obtain supper and a quilt, sleeping, from a not over extensive choice, on some straw, beneath the broad eaves of a log granary adjoining the house.
The game is saved, but not won; another run is wanted. No one says a word, but the Fifth everywhere look on with a confidence which is far more eloquent than words. Raleigh is the bowler from the lower end, and the Sixth send out their hearts to him. He may save them yet! He runs, in his usual unconcerned manner, up to the wicket and delivers the ball.
However humiliating for my self-esteem, I must confess that the counsels of Marcus Aurelius are not for me. They are more fit for a moralist than for an artist. Truth of a modest sort I can promise you, and also sincerity. That complete, praiseworthy sincerity which, while it delivers one into the hands of one's enemies, is as likely as not to embroil one with one's friends.
One of the Fathers says, 'Gaming table. Another of the Fathers says, 'Speculated without knowing that speculation is a science. Boots says 'Horses. Lady Tippins says to her fan, 'Two establishments. Mr Podsnap, saying nothing, is referred to for his opinion; which he delivers as follows; much flushed and extremely angry: 'Don't ask me.
But the explanation does not come; there is none in the homely and not very lofty regions wherein we hoped to find one; there is neither fault nor flaw in the mighty evidence; and nothing delivers us from the mystery. It must be confessed that this mystery, springing from a point where we least expected to come upon the unknown, bears enough within itself to scatter all our convictions.
How this promise goes out beyond our human ministries of consolation! How often the most we can do is to walk by our brother's side whilst he bears a burden we cannot share! How often the earthly sympathy is just a communion of sad hearts one weak hand holding another! 'I will deliver him. That is not merely sympathy, it is victory. The divine love does not merely condole, it delivers.
Christ is well named the Redeemer, because He frees the sinful soul from all this. He delivers it from the penalty, by assuming it all upon Himself, and making complete satisfaction to the broken law. He delivers it from the perpetual restraint and the irksome effort, by so renewing and changing the heart that it becomes a delight to keep the law.
