Marcia Fenton and Ella Backus faded into nothingness when she was near, and they laughingly complained to Richard that his wife had stolen all their beaux away, and they wished he would make her do better. "I wish I could," was his reply, spoken not playfully, but moodily, just as he felt at the time.
He took his hand, glanced at it, and his dull eyes lit up for a moment. The gamblers observed it, and showed their gratification by hardly perceptible signs. 'How many cards? 'None! said Backus. One villain named Hank Wiley discarded one card, the others three each. The betting began.
As I moved away, I saw one of the gamblers approach and accost him; then another of them; then the third. I halted; waited; watched; the conversation continued between the four men; it grew earnest; Backus drew gradually away; the gamblers followed, and kept at his elbow. I was uncomfortable. However, as they passed me presently, I heard Backus say, with a tone of persecuted annoyance
"But if you are hunting for destitute places," he told us, "I wish you would go to Ship Island, in the Gulf of Mexico, as there are soldiers and many prisoners there, and they have no chaplain or agent to look after their sanitary condition" While I was inclined to go, sister Backus thought, in view of the very warm weather, and because we were so nearly worn out with several months constant toiling, we had better turn our faces homeward.
A jury to hold Backus blameless had been secured, but they overshot their mark the thing was too transparent, too bare-faced. The murdered man was a German much respected by his countrymen. They determined to press the matter to justice. Backus was indicted, tried, convicted of murder and sentenced to death. None of just mind questioned the righteousness.
There was one transaction, viz., the purchase of the property of the Backus Oil Company, which has been variously exploited, and I am made to appear as having personally robbed a defenceless widow of an extremely valuable property, paying her therefor only a mere fraction of its worth.
Backus was a frequent visitor at a house of the demi-monde in the alley, and one Jennie French was his favorite. As he came to visit her one evening, at dusk, she was standing in the doorway, at the head of the iron stairway which led to the entrance on the second floor. On the opposite side of the alley, walking slowly toward Jackson street, was a man of ordinary appearance.
It seemed as if she was to be left alone, for two days after Melinda's return, Marcia Fenton and Ella Backus came out from Camden to call, and communicated the news that they, too, were going on to Washington, together with Mrs. Judge Miller, whose father was a United States Senator.
In 1840, Mr. Backus associated himself in the legal practice with J. P. Bishop, Esq., with whom he continued for fifteen years. Mr. Bishop was afterwards chosen one of the judges of the Court of Common Pleas of the Cleveland district.
Among the members of the Cleveland Bar who studied under them are Messrs. F. T. Backus, George Willey, John E. Cary and his present partner, Mr. Griswold. Mr. Kelly was City Attorney in the year 1839, and a member of the City Council in 1841.
