Like a thief in the night he sneaks into the private lives of the people, into their most intimate relations. The system of espionage established by this man Comstock puts to shame the infamous Third Division of the Russian secret police.
In 1873, the late Anthony Comstock, who with a list of contributors, most of whom did not realize the real effects of his work, constituted the so-called Society for the Suppression of Vice, succeeded in obtaining the passage of the federal obscenity act. This act was presented as one to prevent the circulation of pornographic literature and pictures among school children.
Such a provision existed hi the constitution of the State of New York, adopted in 1846, and it was to invoke the protection of this clause that one Wynehamer, who had been indicted in 1855, carried his case to the Court of Appeals in the year 1856. In that cause Mr. Justice Comstock, who was one of the ablest jurists New York ever produced, gave an opinion which is a model of judicial' reasoning.
