It was, indeed, often applied to all civilians as contradistinguished from the military caste; and this fact may have had a certain influence, when the idea of the faithful as soldiers of Christ was strongly realized in the minds of men. But it was mainly in the following way that it grew to be a name for those alien from the faith of Christ.

In the Philippines any white suit which consists of well fitting trousers and a coat buttoning up to the throat, as contradistinguished from baggy pantaloons with a camisa worn on the outside, is called by the natives an "Americano," and is by them greatly admired from a sartorial standpoint.

The jurisconsults of former times expressed the idea by the words RES FUNGIBILES, by which they meant consumable commodities, or those things which are consumed in their use for the supply of man's animal wants, as contradistinguished from unconsumable commodities, which latter writers, by an extension of the term, in a figurative sense, have called FIXED capital."

And don't fall back upon the musty subterfuge which, by a shifting value of the term, represents 'gentleman' as simply signifying a man of honour, probity, education, and taste; for, by immemorial usage, by current application, and by every rule which gives definite meaning to words, the man with a shovel in his hand, a rule in his pocket, an axe on his shoulder, a leather apron on his abdomen, or any other badge of manual labour about him his virtues else be they as pure as grace, as infinite as man may undergo is carefully contradistinguished from the 'gentleman. The 'gentleman' may be a drunkard, a gambler, a debauchee, a parasite, a helpless potterer; he may be a man of spotless life, able and honest; but he must on no account be a man with broad palms, a workman amongst workmen.

And we may add that Caesar was constitutionally, as well as by accident of position, too much a man of the world, had too powerful a leaning to the virtues of active life, was governed by too partial a sympathy with the whole class of active forces in human nature, as contradistinguished from those which tend to contemplative purposes, under any circumstances, to have become a profound believer, or a steadfast reposer of his fears and anxieties, in religious influences.

If less, then how improperly were all those names of rule and government imposed upon officers, which nowhere are given by Scripture to the multitude! as Pastors, Eph. iv. 8, 11. Elders, 1 Tim. v. 17. Overseers, Acts xx. 28. Guides, Heb. xiii. 7, 17, 22. In this last verse they are contradistinguished from the saints; church-guides, and saints guided, make up a visible organical church.

In this beautiful constellation we witness the reaction of Gemini, the closing scene in act II. Hence it is, of course, a feminine force we are observing. Just so Cancer, spiritually interpreted, means equalizing, hence HARMONY, which is indeed very good as contradistinguished from chaos. To the human soul Cancer is the period of exalted rest.

Then contemplate that excellence which is shown in the conduct of civil cases as contradistinguished from criminal that various power here, too, of speech, in itself the lesson of a life to learn the skill, too, in addressing juries and the court with equal effect; that knowledge of the law in its innumerable doctrines, principles, and decisions, which made the study even in Lord Coke's day the work of twenty years; the prompt application of this learning to the rapid matter in hand; the magical use of the faculties of the mind and the wondrous discipline which they must have undergone, every hour, every minute demanding a stretch of thought and an adroitness of discrimination which have justly classed the dialectics of the bar above all the dialectics of the schools; and the moral as well as intellectual qualities necessary in an adept in the varying practice of municipal law; and here, too, we will yield to the general opinion which places excellence in this single department one of the highest achievements of mind; and then recall what such a judge as Spencer Roane, the ablest and sternest judge of the age, and politically hostile to Tazewell, said when Tazewell pleaded the case of Long vs.

As soon as the process becomes 'natural' it ceases to demand the supernatural artificer. 'Making, therefore, is contradistinguished from 'growing. If we see how the eye has come into existence, we have no longer any reason to assume that it was put together mechanically. In other words, 'teleology' of this variety is dispelled by theories of evolution.

It is well known that on the trial of Hastings the managers of that impeachment, and most especially Burke, claimed a right of giving evidence such as no court of law would have admitted, and set up what they entitled "a usage of Parliament independent of and contradistinguished from the common law."
