One wild, terrific wave of blasphemy is sweeping over the land. See the effects of this widespread profanity in the increasing perjury. If men in ordinary conversation so commonly use the name of God, is it wonderful that in the jury-box, and in the alderman's office, and in the custom-house so many swear falsely? Notice the way an oath is administered.
A penitent heart, or a consciousness of the pardon of God, are not fit considerations for a jury-box. You are, therefore, to exclude the motive, and to take nothing into consideration but the act; for it is only that by which the law has been violated. "'But is there no such thing as mercy, my lord? asked a juror.
But in the general stillness, there was one part of the court that was not still, but the judge made no command of silence there, for in the jury-box there was whispering and consultation. It went on for some three minutes. Then the foreman of the jury stood up. "The jury have heard sufficient of this case, my lord," he said, "and they are agreed on their verdict."
The case is thrown into the jury-box, to be decided at haphazard, according as the twelve men may chance to think or feel. He, who narrowly watches such controversies, cannot fail to see that the right of a counsel to enforce his claim for legal compensation is far from being calculated to protect the client from oppression and extortion.

The jury being formed, the judge called the plaintiff.
Just then he heard his name called by the crier, and he had to go into court to answer. He was wild with apprehension of coming trouble; but he took his seat in the jury-box and determined to explain the situation to the court at the earliest possible moment.
Harvey himself tried to point out the unlikelihood of his being guilty; but he was not a man gifted with dialectic qualities, and his harangue fell pointless on the understandings of the twelve common-place individuals who sat in the jury-box.
Meanwhile the great argument had been begun in the jury-room, and all the points that had been meditatively speculated upon in the jury-box were now being openly discussed. It is amazingly interesting to see how a jury will waver and speculate in a case like this how curious and uncertain is the process by which it makes up its so-called mind.
These words fell like a thunderbolt upon the assembly. The prisoner's face grew pale; he grasped the railing in front of him and gazed wistfully at the jurors who stood beside him. "Prisoner at the bar, stand up," said the clerk; and Bucholz arose immediately, turning his pallid face toward the jury-box.
They hold up their hands. The judge also rises. "Gentlemen," he says, "Do you each and all of you solemnly swear to well and truly try the case of John Smith against Thomas Gregory and a just verdict render according to the evidence? So help you God." They do not answer, but they sit down. The jury is chosen, sworn, and sitting in the jury-box.
