The Crown has no such power in England, because it must change its ministers whenever called upon to do so by the House of Commons. But the Colonial Minister in Downing Street is the Crown's Prime Minister as regards the colonies, and he is changed not as any colonial House of Assembly may wish, but in accordance with the will of the British Commons.
There are two royal fish so styled by the English law writers the whale and the sturgeon; both royal property under certain limitations, and nominally supplying the tenth branch of the crown's ordinary revenue.
Sheriff Crown's car came whirling up the driveway; and Hastings spoke hurriedly: "You know he's not as sick as he makes out. He's got to tell me what he knows, judge! He's holding back something. That's why he wants to make me so mad I'll quit the case. Who's he shielding? That's what people will want to know." Wilton pondered that. "I'll see what I can do," he finally agreed.
Nor was it made more acceptable by the explanation of Lord Brougham, who on this occasion came to the support of the minister, that the refusal of the crown's consent at this stage was "a warning, as it were, a polite and courteous communication between the sovereign, as guardian of the privileges of the crown, and the two Houses of Parliament, that if they passed a certain bill it would not receive the royal assent;" for, though the right to refuse the royal assent to any bill was incontestable, it had not been exercised since the time of William III., and to put it in force for the protection of an imaginary interest of the crown itself would have been so unpopular an exercise of it that no administration could have ventured to advise it.
The bill, however, passed the legislature by a large majority, and received the crown's assent through Lord Elgin on the 25th April, 1849. A large crowd immediately assembled around the parliament house formerly the St. Anne Market House and insulted the governor-general by opprobrious epithets, and by throwing missiles at him as he drove away to Monklands, his residence in the country.
'Did you never see a locksmith before, that you start as if you had come upon a ghost? cried the old man in the chaise, 'or is this, he added hastily, thrusting his hand into the tool basket and drawing out a hammer, 'a scheme for robbing me? I know these roads, friend. When I travel them, I carry nothing but a few shillings, and not a crown's worth of them.
"Well, if it had been a pleasant night he'd have been up at Alix Crown's instead of here," said Charlie. "I see," said Flora, after a moment. "You mean the ill wind favoured Alix, eh?" Charlie's round face was unsmiling as he stared hard at the fire. "I wonder " he began, and then checked the words. "Don't you worry about Alix," said Flora. "She's nobody's fool."
He brought two actions of trespass, one of which was against Sheriff Leonard and Captain Phillpotts jointly, for removing the fence and blacksmith's shop; and the other of which was against Captain Phillpotts alone for removing the fence the second time. Sir Peregrine instructed Attorney-General Robinson to defend both these suits, and to vindicate the Crown's title to the reserved land.
So the government advisers suggested a compromise. Falling back on a still older feudal doctrine, they asserted the indefeasible right of the Crown to all gold found either on private or public lands, but recommended that licenses to dig should be granted on easy terms, which would have the double effect of providing a revenue and of preserving an acknowledgment of the Crown's title.
I forgot to ask you how bad it is. I forgot everything but but just speaking to you. Is it dangerous? Is it a bad wound?" "I don't know. The doctor is waiting for me up at Miss Crown's. They sent me back, the other fellows did. I wanted to go with the gang, but I was weak and Oh, I'll be all right. Don't you worry, little girl. Dr. Smith may slap me into bed, " "You must not be foolish, Courtney.
