The street swarmed with boomers. All talk was of lots, of land. Hour by hour as the sun sank, prospectors returned to the hotel from their trips into the unclaimed territory, hungry and tired but jubilant, and as they assembled in my father's store after supper, their boastful talk of "claims secured" made me forget all my other ambitions.

The lord of Serravalle was Manfred, a German, who, before Castruccio became lord of Pistoia, had been allowed to remain in possession of the castle, it being common to the Lucchese and the Pistoians, and unclaimed by either neither of them wishing to displace Manfred as long as he kept his promise of neutrality, and came under obligations to no one.

Instead of impeding enfranchisement, the laws, as well as the public feeling, encouraged it. If a villein who had fled from his lord remained a year and a day unclaimed upon the King's demesne lands, or in any privileged town, he became free. All doubtful cases were decided in favorem libertatis.

No one besides himself and those immediately concerned, ever knew anything about the matter. He never asserted any right to these pieces, he never sought to collect them, though some of them exhibited his happiest vein of humor. Unclaimed, unidentified, they are swept into that wallet of oblivion in which time stows the best as well as the worst of newspaper production.

There was always the assumption of a common origin, an assumption sometimes notoriously at variance with fact; and, to repeat the historian's words, "if a family became extinct, its share returned to the common stock." In old Roman law, unclaimed inheritances escheated to the Gentiles.

Now the admiral of the coast had this piratical privilege: and as, in former days, sextants and chronometers were unknown, sea-faring men incurred more risk than they do at present, and the wrecks which strewed the coast were of very great value. I had a proof the other day that this right is still exacted; that is as far as regards property unclaimed.

My theory stands or falls upon one point, and I call upon the railway company to make strict inquiry as to whether a ticket was found unclaimed in the local train through Harrow and King's Langley upon the 18th of March. If such a ticket were found my case is proved.

A serf might also gain his liberty by fleeing to a town. If he remained undiscovered, or was unclaimed by his lord, for a year and a day, he became a freeman. The slow extinction of serfdom in western Europe appears to have begun as early as the twelfth century. Germany was far more backward in this respect.

Mavis went upstairs, past the cupboard containing Miss Nippett's collection of unclaimed "overs," to the door directly beyond. "Come in" cried a well-remembered voice, as Mavis knocked. She entered, to see Miss Nippett half rising from a chair before the fire. She was startled by the great change which had taken place in the accompanist's appearance since she had last seen her.

"We'd be locked up as runaway slaves," I said, "advertised, sold to the highest bidder if unclaimed and henceforth kept in slavery." "I'm in slavery now," said Agathemer. "You, if kept in slavery, would at least be alive and in no danger of being recognized." "Let us go," said I. We looked at each other and burst out laughing.
