These requests to charge may go back and forth indefinitely with rulings and exceptions. Either lawyer may except to a portion of the judge's charge, thus serving notice upon him that unless he hurry up and change it he may be reversed on appeal. That is the reason why the charge of the judge has not a great effect. He has to be too careful.
The tariff rulings had their weight, as did the unfair division of new territory: but the main issue was negro slavery, which, always a stumbling-block to the North, had most violently agitated the whole country for eleven years before the appeal to arms. Negro laborers were brought to Virginia and sold as slaves, fifty years after the first cargo landed at Jamestown.
The English text-books, which are meant for practical purposes, are generally 'collections of enormous masses of isolated rulings generally relating to some very minute point. They are arranged with reference to 'vague catchwords, familiar to lawyers, rather than to the principles really invoked.
This volume contains the rulings and decisions by me most of which have been sustained by the courts or justified by experience.* My successor was Joseph J. Lewis, a country lawyer from Pennsylvania. He had written a biography of Mr. Lincoln, and he had been the President's choice at the outset. When I resigned, the President had his way. Whether Mr. Chase presented any other person I cannot say.
Obviously, however, there was a weak point in this kind of arbitrary rulings of the board; it was conceivable that some enterprising Attorney-General might want to know why the board had not held the good conduct specified in the law to be sufficient ground for freeing the man. To guard against this, the services of a subordinate called the parole officer were called in.
Fraunhofer, who initiated the study of the diffraction spectrum, used a real grating of very fine wires: but rulings on glass were adopted by his successors, and were by Nobert executed with such consummate skill that a single square inch of surface was made to contain 100,000 hand-drawn lines.
One last word Doctor Penfield's rulings will be the products of his own well-ordered mind after consultation and agreement with the Council of this city, and will be for the best good of all. I do not anticipate any refusal to cooperate with him.
This was an intimation that American vessels, like those of other neutrals, must comply with the U-boat rulings or take the consequences. Hence more American vessels were sunk, Germany pursuing her evil way regardless of the American attitude.
Unfortunately, the brilliant arraignment by William Wirt was printed and read for half a century, while the calm rulings of Chief Justice Marshall never went beyond the court room. Why did a man of his capabilities, upon retirement from the vice-presidency, attempt, at fifty years of age to start life anew under such unpromising conditions?
John R. Lynch, when Speaker of the Mississippi House of Representatives, was given a public testimonial by Republicans and Democrats, and the leading white paper said, "His bearing in office had been so proper, and his rulings in such marked contrasts to the partisan conduct of the ignoble whites of his party who have aspired to be leaders of the blacks, that the conservatives cheerfully joined in the testimonial."
