At this time Whitelock had been about seven years at the bar; but at the Quarter-Sessions the young Templar was playing the part of country squire, and as his words show, he was dressed in a fashion that directly violated professional usage. Whitelock's speech seems to have been made shortly before the bar accepted the falling-band as an article of dress admissible in courts of law.
He was as communicative as hosts usually are: the crops and the markets, the price of beasts at last Castle Dermot fair, the last story about the vicar, and the last joke of Father Hogan the priest; how the Whiteboys had burned Squire Scanlan's ricks, and the highwaymen had been beaten off in their attack upon Sir Thomas's house; who was to hunt the Kilkenny hounds next season, and the wonderful run entirely they had last March; what troops were in the town, and how Miss Biddy Toole had run off with Ensign Mullins: all the news of sport, assize, and quarter-sessions were detailed by this worthy chronicler of small-beer, who wondered that my honour hadn't heard of them in England, or in foreign parts, where he seemed to think the world was as interested as he was about the doings of Kilkenny and Carlow.
Here is the sum of my Examination before Justice Keelin, Justice Chester, Justice Blundale, Justice Beecher, and Justice Snagg, &c. After I had lain in prison above seven weeks, the quarter-sessions was to be kept in Bedford, for the county thereof, unto which I was to be brought; and when my jailer had set me before those justices, there was a bill of indictment preferred against me.
Out of eighteen male prisoners who were brought to trial at the last Quarter-Sessions, twelve in my opinion committed their offences for the direct purpose of being sent to prison. Most of the vagrants committed to the prison still pass their time in idleness; no prisoners except those sentenced to hard labour being set to work."
There was no more conscientious magistrate in all the county than his lordship: he was never known to miss church or quarter-sessions; he was the strictest game-proprietor in all the Riding, and sent scores of poachers to Botany Bay. Property has its duties as well as its privileges, and a person of my rank is bound to live on the land from which he gets his living."
At the Westminster quarter-sessions, on the 27th of October, bills of indictment were preferred against forty-one persons for creating a disturbance and interrupting the performances of the theatre. The grand jury ignored twenty-seven of the bills, left two undecided, and found true bills against twelve. The latter exercised their right of traverse till the ensuing sessions.
Obs. Second. But secondly, as the whole body of the elect, by the nature of conversion in their hearts, shall witness a non-conversion in the hearts of the wicked; and as the ungodly shall fall under the conviction of this cloud of witnesses: so, to increase their conviction, there will also be opened before them all the labours of the godly, both ministers and others, and the pains that they have taken, to save, if it had been possible, these damned wretches; and now will it come burning hot upon their souls, how often they were forewarned of this day; now they shall see, that there was never any quarter-sessions, nor general jail-delivery more publicly foretold of, than this day.
In fact, the fears of the honest Justice, however ridiculously exorbitant, were kept so much in countenance by the outcry of the day, and the general nervous fever, which afflicted every good Protestant, that Master Maulstatute was accounted the bolder man and the better magistrate, while, under the terror of the air-drawn dagger which fancy placed continually before his eyes, he continued to dole forth Justice in the recesses of his private chamber, nay, occasionally to attend Quarter-Sessions, when the hall was guarded by a sufficient body of the militia.
Old Sir Huddleston wheezed a great deal at dinner; Sir Giles Wapshot had a particularly noisy manner of imbibing his soup, and her ladyship a wink of the left eye; all of which Becky caricatured to admiration; as well as the particulars of the night's conversation; the politics; the war; the quarter-sessions; the famous run with the H.H., and those heavy and dreary themes, about which country gentlemen converse.
The severity of the magistrates at the quarter-sessions was equally revolting.
