It is worthy of mention, as illustrating the administration of Justice in Rome, that even with these proofs of the invalidity of the will produced as that of Vitelli, his nieces were never able to recover the whole of his property. They were compelled to make terms with Grossi, the defunct Prelate's natural son, who to this day remains in the enjoyment of one-half of Vitelli's property!

It has been taxed indirectly in two different ways; first, by requiring that the deed, containing the obligation to repay, should be written upon paper or parchment which had paid a certain stamp duty, otherwise not to be valid; secondly, by requiring, under the like penalty of invalidity, that it should be recorded either in a public or secret register, and by imposing certain duties upon such registration.

This rescript having produced no effect, the arrêt was answered in February by an imperial decree of commission carried to the dictature, importing, that the imperial court could no longer hesitate about the execution of the ban, without infringing that very article of the capitulation which they had specified: that the invalidity of the arrêt was manifest, inasmuch as the electors of Brandenburgh and Brunswick, the dukes of Saxe-Gotha and Brunswick-Wolfenbuttel, and the landgrave of Hesse-Cassel, were the very persons who disturbed the empire, this, therefore, being an affair in which they themselves were parties, they could not possibly be qualified to concur in a resolution of this nature; besides, the number of the other states which had acceded was very inconsiderable: for these reasons, the emperor could not but consider the resolution in question as an act whereby the general peace of the empire was disturbed, both by the parties that had incurred the ban, and by the states which had joined them, in order to support and favour their frivolous pretensions.

A theory which rests exclusively on arguments derived from human reason may, at some other time or place, be disestablished by arguments devised by people more skilful than you in reasoning; and thus there is no getting over the objection founded on the invalidity of all mere argumentation.

It may however be admitted to explain what is doubtful, or to supply some deficiency. To make a valid contract, the parties must be capable of contracting. They must be of sound mind. Hence idiots and lunatics are generally incompetent to make contracts. Contracts by lunatics and idiots are not necessarily void, but only voidable; the validity or invalidity depending upon facts to be proved.

The promulgation in 1908 of the Vatican decree, Nec Temere, a papal reassertion of the canonical invalidity of mixed marriages, followed as it was by notorious cases of the victimisation of Protestant women by the application of its principles, did not encourage the Protestants to welcome the prospect of a Catholic Parliament that would have control of the marriage law; nor did they any more readily welcome the prospect of national education on purely ecclesiastical lines.
