Rhode Island was the only state that failed to send delegates. Instead of taking up the interstate commerce questions the convention formulated the present Constitution. In a special message transmitted to the Congress on the 11th of January, 1911, in which I concurred in the recommendations made by the Secretary of State in regard to certain needful legislation for the control of our interstate and foreign traffic in opium and other menacing drugs, I quoted from my annual message of December 7, 1909, in which I announced that the results of the International Opium Commission held at Shanghai in February, 1909, at the invitation of the United States, had been laid before this Government; that the report of that commission showed that China was making remarkable progress and admirable efforts toward the eradication of the opium evil; that the interested governments had not permitted their commercial interests to prevent their cooperation in this reform; and, as a result of collateral investigations of the opium question in this country, I recommended that the manufacture, sale, and use of opium in the United States should be more rigorously controlled by legislation.

The other suggestions-the increase in the Interstate Commerce Commission's membership and in its facilities for performing its manifold duties; the provision for full public investigation and assessment of industrial disputes, and the grant to the Executive of the power to control and operate the railways when necessary in time of war or other like public necessity-I now very earnestly renew.

Under his direction, the Interstate Commerce Law has been vastly improved, postal savings banks have been established, and the conservation of our natural resources has been placed upon a safe and sane basis.

Whether the shipper or the railroad is to blame makes no difference; the rebate must be stopped, the abuses of the private car and private terminal-track and side-track systems must be stopped, and the legislation of the Fifty-eighth Congress which declares it to be unlawful for any person or corporation to offer, grant, give, solicit, accept, or receive any rebate, concession, or discrimination in respect of the transportation of any property in interstate or foreign commerce whereby such property shall by any device whatever be transported at a less rate than that named in the tariffs published by the carrier must be enforced.

The country is ready, therefore, to accept, and accept with relief as well as approval, a law which will confer upon the Interstate Commerce Commission the power to superintend and regulate the financial operations by which the railroads are henceforth to be supplied with the money they need for their proper development to meet the rapidly growing requirements of the country for increased and improved facilities of transportation.

Instead of standing firmly on the principle of arbitration, the President chose to go before Congress, on the afternoon of the 29th of August, and ask, first, for a reorganization of the Interstate Commerce Commission; second, for legal recognition of the eight-hour day for interstate carriers; third, for power to appoint a commission to observe the operation of the eight-hour day for a stated time; fourth, for reopening the question of an increase in freight rates to meet the enlarged cost of operation; fifth, for a law declaring railway strikes and lockouts unlawful until a public investigation could be made; sixth, for authorization to operate the roads in case of military necessity.

I draw this inference from the fact that in the next quarter resistance to capitalistic methods began to take shape in such legislation as the Interstate Commerce Law and the Sherman Act, and almost at the opening of the present century a progressively rigorous opposition found for its mouthpiece the President of the Union himself.
