The Supreme Court had resumed its session only a few days, when, in 1803, Marshall made a decision in the case of Marbury vs. Madison. Marbury was one of Adams's "midnight appointments;" the suit was brought for his commission, which had not been delivered, and was retained by Madison when he became Secretary of State.

Carleton, according to the Memoirs, made his first service in the navy in 1672 seventeen years before the siege of Derry. There is no mention of this siege in the book.
By the treaty of San Ildefonso in 1800, France acquired an imperfect title to Louisiana; by the treaty of Paris in 1803, she conveyed all her title to the United States. But, before the United States would pay over any money on account of the treaty of 1803, she required Spain to confirm the treaty of San Ildefonso by putting France into the actual possession of Louisiana.
A new stone citadel is in a course of building, on which the Royal Standard, for the first time in these settlements, was hoisted on the 4th of June, 1803; and several batteries are erected.
