There was not even a suggestion that the Protestant doctrines were true, and the Catholic doctrines false. The matter was merely taken up on the 'uti possidetis' principle, that they who had acquired the fact of Protestant worship had a right to retain it, and could not justly be deprived of it, except by instruction and persuasion.

Ergo veneno quoque uti fas est', etc., whereas I cannot conceive that the use of poison can, upon any account, come within the lawful means of self-defense.

UTERETURNE etc.: 'whether he still took pleasure in love'; uti = frui. Cf. Ovid, Met. 4, 259 dementer amoribus uti with Cic. Tusc. 4, 68 venereis voluptatibus frui. DI MELIORA: sc. duint; this archaic form usually occurs when the phrase is given in full. ISTINC etc.: cf. the passage in Plato, Rep. 1, 329 C. For istinc used otherwise than of place cf. unde in 12 with n.

No uti possidetis conveys any legitimate title, except on the condition of wise administration and mutual benefit. But will it be enough to make the freedmen landholders merely? Must we not make them voters also, that they may have that power of self-protection which no interference of government can so safely, cheaply, and surely exercise in their behalf?

In the meanwhile it is not considered, that mentes humanae mirificae capiuntur et facinantur, ceremoniarum splendore et pompa. Videmus siquidem, saith Bucer, vulgus delectari actionibus scaenicis, et multis uti signis. Chemnitius marks of the cumulating of ceremonies in the ancient church, that it drew to this, ut tandem in theatricum ferme apparatum ceremoniae illae abierint.

The Prince of Orange, it is evident, was placed in such a position, that it would be difficult for him to satisfy all parties. He intended that the marriage, like all marriages among persons in high places at that day, should be upon the "uti possidetis" principle, which was the foundation of the religious peace of Germany.

The principle of the negotiation was that of uti possidetis, but it failed, as Whitworth's efforts had failed, because the pretensions of France were constantly shifting, and especially because France, anxious to isolate Great Britain, insisted on negotiating separately with Great Britain and Russia, while Fox very properly refused to make peace without our ally.

His conduct, therefore, was perfectly consistent; with a bold front he laid down the ultimatum of uti possidetis for the congress, and left for Mainz, where he remained from July twenty-fifth to August first, arranging his military plans for the defense of the Pyrenees, and despatching Soult, who went against his will, for the campaign which sealed the marshal's reputation as a great soldier.

After reporting these views at Downing Street, Lord Yarmouth returned to Paris for further discussions, with the general understanding that the principle of uti possidetis should form their basis except as regards Hanover.
