Infringement of law, even for a good purpose, invariably brings about ultimate contempt, for all law. In the absence of regularly constituted tribunals, as in a primitive society such as that prior to the Constitutional Convention of September, 1849 it may become necessary that informal plebiscites be countenanced.
These were at first intrusted to the care of the censors, afterwards to the praefecti aerarii. Forensia, comprising lists of laws, plebiscites, elections of aediles, tribunes, &c. like the daemosia grammata at Athens, placed among the archives annexed to various temples, especially that of Saturn.
It is needless to lose time in demonstrating for what geographic, ethnographic and economist reason Upper Silesia should be united with Germany. It is a useless procedure, and also, after the plebiscites, an insult to the reasoning powers.
But only for Schleswig, Upper Silesia, Marienwerder, Allenstein, Klagenfurth and the Saar were plebiscites laid down and with the exception that the plebiscite itself, when, as in the case of Upper Silesia, it resulted in favour of Germany, was not regarded as conclusive. But where the most extreme views clashed was in the matter of reparations and the indemnity to be claimed from the enemy.

These plebiscites are called passive propaganda by the French, and they for their part egg on the Petite Entente to stop them. But there seems little doubt that were Austria free to choose she would now give up her name and fame, and merge herself in the German whole of which, ethnographically, she is a natural part.
The corridor to the sea with most of Posen was eventually given to Poland, while parts of East Prussia and Upper Silesia were subjected to plebiscites which promised a similar result; but, like other territorial arrangements in central and eastern Europe, it was a settlement which could never prove satisfactory until racial antagonisms were modified by good government, and it became possible for different nationalities to live together in a State in Europe with as little sense of injustice and exploitation as immigrants in the United States of America.
