When the time for the trial has arrived, and the case is called on, jurors, to the number of twelve, are sworn, unless challenged as they appear; their names being generally taken promiscuously, one by one, out of a box containing a number of tickets, on each of which a juror's name is inserted.
A case had just closed, and the last juror's back was seen escaping through the door in the wall of the jury-box.
It is, however, significant of one of the great principles of Anglo-Saxon law, and that is a trial by a court of average men selected from among the ordinary citizens and drawn on the particular case by chance. As each juror's name is called he comes forward and his appearance is not lost by counsel.
He is endeavoring to persuade and convince twelve men upon a question in which they have no direct pecuniary or personal interest, and he must more or less know and adapt his reasoning and his style to each juror's mind. He should know no audience but the judge and these twelve men. Retainers never seek and should not find counsel who address jurors with classical or formal correctness.
Mournful as is the duty, and awfully solemn the necessity that leaves the issue of life and death in your hands, remember, gentlemen, Curran's immortal words: 'A juror's oath is the adamantine chain that binds the integrity of man to the throne of eternal justice'."
The meeting, made up like all meetings of divers elements and subject to sudden and incalculable moods, approved these sentiments. But the citoyen Dupont returned to the charge; he could not forgive Gamelin for having secured a post he had coveted himself. "I understand," he said, "I even approve the juror's scruples.
Fairbrother whether he had anything to say, why judgment should not follow on the verdict? The counsel had spent some time in persuing and reperusing the verdict, counting the letters in each juror's name, and weighing every phrase, nay, every syllable, in the nicest scales of legal criticism. But the clerk of the jury had understood his business too well.
"Well, sir, perhaps he wasn't to say agitated, he looked more blank, yes, as you might say, blank." "Was he trembling?" persisted Mr. Orville, "was he pale?" and the coroner frowned slightly at this juror's repeated inquisitiveness. "Louis is always pale," returned the butler, seeming to make an effort to speak the exact truth.
Or if he does not accept him as truthful, he thinks it will not be worth while to ask him other questions. An inference may be drawn as to the juror's attitude for and against. An inexplicable thing to the jury is when the judge takes the case away from them and directs a verdict or dismissal of the complaint.
From the same sketches he had over-doors and panels executed, which sold as well or better than the decorative works of Hubert Robert. On this occasion he had invited the citoyen Gamelin to accompany him to sketch buildings after nature, so much had the juror's office increased the painter's importance in his eyes.
