But although the bag was empty it was suggested at the hearing that while at McMurdo Captain Gemmell might have "collected a quantity of documents from the crash site and brought them back to Auckland"; that only three of the flight documents carried on the aircraft had been produced to the Royal Commission; that it was "curious" to find that each favoured the case "which the airline was now attempting to advance"; and all this against counsel's theory that before Captain Gemmell had left Auckland on 29th November he was aware of possible problems associated with the amendment to the destination point co-ordinates.

David said between his teeth: "We hope there will soon be a child in this house, also. God forgive me, but I cannot bring her back here." "She cannot be in a house where there is a child!" said Tommy, with a bitter laugh. "Gemmell, it is Grizel we are speaking of! Do you remember what she was?" "I remember." "Well, where are we to send her?" David turned his pained eyes full on Tommy. "No!"

There are few of them, even in a little place like Thrums; but David Gemmell was one. So McQueen had always said, but Grizel was not so sure. "He is very good-looking, and he does not know it," she would point out. "Oh, what a remarkable man!"

This disposes of any inference against Captain Gemmell that might be taken from that paragraph. Much the same applies to the other paragraphs affecting him which are complained of. We have set them out in full and it will be seen that they all relate to two flight bags.

The affidavit indicates that the police officer arrived to take charge of the police store only on the evening of 6th December and by then Captain Gemmell had been back in New Zealand for two days. Airline's Attitude at Inquiry This matter requires brief comment.

I did not even think her unduly severe upon Mary, after I heard her giving that damsel "Hail Columbia" for her carelessness in having administered the wrong medicine one whole forenoon to Number Nine which was myself. If I had not made a feeble protest in her favor, "Nurse Gemmell" would have been discharged on the spot.

"Would you mind if he called me 'Mary Gemmell'? There aint any name that I've a right to, and I don't want to be called 'Mason, because that's the name of the woman that abused me when I was little. I'd rather have yours." She was such a pathetic-looking young person, standing there before Belle in her fresh and innocent loveliness, that my wife had not the heart to refuse her anything.

I micht 'a' kent what wad happen when I h'ard tell o' ye bein' merrit till an Amerrican." "Hold up there, mother. You're just twenty years too late in raking up that story. If it suits me and Belle to have that girl called 'Mary Gemmell, Mary Gemmell she shall be, if it turns all Scotland head over heels into the North Sea."

However, it requires some specific mention because in paragraph 352 it has been associated with Captain Gemmell and as all counsel now acknowledge this has been done in error. The paragraph is one of the specific paragraphs challenged by these proceedings.

No complaint has ever been made by Mr Chippindale about a missing blue envelope or papers within it. If Captain Gemmell had been entrusted with such a mission which he had failed to discharge Mr Chippindale would seem to be the first person who would want to know why.
