The appointment to the Sheriff ship was made on December 16, 1799. It brought him an annual salary of £300; the duties of the office were far from heavy; the small pastoral territory was largely the property of the Duke of Buccleuch; and Scott turned with redoubled zeal to his project of editing the ballads, many of which belong to this district.

Great part of his forfeited estate was bestowed on Walter Scott, first Lord of Buccleuch, and on the first Earl of Roxburghe. Francis Stewart, son of the forfeited Earl, obtained from the favour of Charles I. a decreet-arbitral, appointing the two noblemen, grantees of his father's estate, to restore the same, or make some compensation for retaining it.

For smaller depredations, the old laws of the Border and it would not be fair to exclude those of the present day, not confined to that locality awarded a halter; for thefts of a larger kind, they gave a title. Old Wat of Buccleuch deserved the honour of "the neck garter" just as much as poor Johnny Armstrong; yet all he got was a reproof and a dukedom.
An earlier mistress, Lucy Walters, declared him, it is believed falsely, father of the boy whom he raised to the dukedom of Monmouth, and to whom the Dukes of Buccleuch trace their line. But Charles was far from being content with these recognized mistresses or with a single form of self-indulgence.
