He received an academical education, and engaged in mercantile pursuits. Removing to California, he settled in San Francisco. He held for some time the office of Harbor Commissioner for that State.
In 1864 he was a delegate to the Baltimore Republican Convention, and was in the same year elected a Representative from Ohio to the Thirty-Ninth Congress. His successor in the Fortieth Congress is George W. Morgan. 236, 285 539, 564. HENRY C. DEMING was born in Connecticut. He graduated at Yale College in 1836, and at the Harvard Law School in 1838.
It was at once seen, therefore, that, should the existing House of Representatives fail to adopt the Thirteenth Amendment to the Constitution, there would be much more than the requisite two-thirds majority for such a Measure in both Houses of the succeeding Congress; and moreover that in the event of its failure at the coming Session, it was more than probable that President Lincoln would consider himself justified in calling an Extra Session of the Thirty-ninth Congress for the especial purpose of taking such action.
And be it further enacted, That when the people of any one of said rebel States shall have formed a constitution of government in conformity with the Constitution of the United States in all respects, framed by a convention of delegates elected by the male citizens of said State twenty-one years old and upward, of whatever race, color, or previous condition, who have been resident in said State for one year previous to the day of such election, except such as may be disfranchised for participation in the rebellion, or for felony at common law; and when such constitution shall provide that the elective franchise shall be enjoyed by all such persons as have the qualifications herein stated for electors of delegates; and when such constitution shall be ratified by a majority of the persons voting on the question of ratification who are qualified as electors for delegates, and when such constitution shall have been submitted to Congress for examination and approval, and Congress shall have approved the same; and when said State, by a vote of its legislature elected under said constitution, shall have adopted the amendment to the Constitution of the United States proposed by the Thirty-ninth Congress, and known as article fourteen; and when said article shall have become a part of the Constitution of the United States, said State shall be declared entitled to representation in Congress, and senators and representatives shall be admitted therefrom on their taking the oath prescribed by law; and then and thereafter the preceding sections of this act shall be inoperative in said State: Provided, That no person excluded from the privilege of holding office by said proposed amendment to the Constitution of the United States shall be eligible to election as a member of the convention to frame a constitution for any of said rebel States, nor shall any such person vote for members of such convention.

In 1851 he was elected Judge and Surrogate for Madison County, and held the office until 1864, when he was elected a Representative from New York to the Thirty-Ninth Congress. His successor in the Fortieth Congress is John C. Churchill. SAMUEL HOOPER was born in Marblehead, Massachusetts, February 3, 1808. Having received a commercial education, he established himself as merchant in Boston.
The thirty-ninth regiment of regulars was now a part of the command, and the general proposed to use them, whenever occasion offered, to suppress insubordination among the volunteers. But from this time he had little of that to deal with, and was free to grapple with the Creeks, who had so far held their own against the Georgians and Mississippians.
In April, 1865, he was elected a member of the Legislature of Tennessee, and in the following August was elected a Representative in Congress. The Tennessee delegation not being admitted at the opening of the Thirty-Ninth Congress, he continued to hold his seat in the Legislature.
I recollect that in the Thirty-eighth or Thirty-ninth Congress he made a violent attack upon Mr. Lincoln, and the Republican Party. The House was in committee, and I was in the chair. Consequently I listened attentively to the speech. It was carefully prepared and modeled apparently upon Junius and Burke a model which time has destroyed.
