It is true, the Clergy of this kingdom, who are promoted to bishoprics, have always some great advantages; either that of rich deaneries, opulent and multiplied rectories and dignities, strong alliances by birth or marriage, fortified by a superlative degree of zeal and loyalty; but, however, they were all at first no more than young beginners; and before their great promotion, were known by their plain Christian names, among their old companions, the middling rate of clergymen; nor could, therefore, be strangers to their condition, or with any good grace, forget it so soon as it hath sometimes happened.
The very carriage in question was no more than one of those pony-phaetons with regard to which Bishop Pattison appealed, in one of his letters from Melanesia to his brethren in peaceful, pleasant country rectories and vicarages at home, asking the astonished clergymen, with their clergywomen in the background, if they really considered the clerical equipage, with its modest expense, equivalent to a divine institution?
But this decision was not given until 1856, when the whole matter of the reserves had been finally adjusted, and the validity of the creation of the rectories was no longer a burning question in Upper Canada.
Years had now passed since he had done a day's duty; and yet there was no reason against his doing duty except a want of inclination on his own part. It was contended that the phrase "Protestant clergy" used in the Constitutional Act, was simply intended to distinguish all Protestant denominations from the Roman Catholic Church, and that, had there been any intention to give exclusive rights to the Anglican Church, it would have been expressly so stated in the section reserving the lands, just as had been done in the sections specially providing for the erection and endowment of Anglican rectories.
He at all events seemed to feel that his creation of the rectories was an extraordinary act, and he took care to say nothing about the matter to the Imperial Government, who did not discover the facts until Sir Francis Head had been for some time in office.
From inquiries made of parties well informed on the subject, both in Canada and the United States, I am convinced that the public act of Sir John Colborne, before quitting the governorship of the province, in 1835, viz., the allotment or appropriation of 346,252 acres of the soil, as a clergy reserve, and the institution of the fifty-seven rectories, was the chief predisposing cause of the insurrection.
And We do further by these presents, for Us, Our Heirs and Successors, will, ordain and grant, to the said Governors, Principal and Fellows, and their Successors, by the name aforesaid, full authority and free license to have, take, purchase, and hold, to them and their Successors to and for the use of the said College, any goods, chattels or personal property whatsoever; and also that by the name aforesaid they shall be able and capable in law, notwithstanding any Statutes or Statute of mortmain, law, usage or custom whatsoever to the contrary, to have, take, purchase and hold to them and their Successors to and for the use of said College, any other Manors, Rectories, Advowsons, Messuages, Lands, tenements, rents and hereditaments of what kind, nature, or quality soever, over and above the manors, rectories, advowsons, messuages, lands, tenements, rents and hereditaments in the said Letter Patent mentioned of the yearly value of six thousand pounds above all charges as in the said Letters Patent is set forth, but not for the purpose or with the view of reselling the same; provided always, that the whole shall not exceed the yearly value of Twelve thousand pounds above all charges, such annual value to be calculated and ascertained at the period of taking, purchasing or acquiring the same;
Lawrence or by annexation to the United States. In Upper Canada, at the same time, matters had come to the verge of rebellion. Sir John Colborne had, just before retiring as Lieutenant Governor in 1836, added fuel to the flames by creating and endowing some forty-four rectories, thus strengthening the grip of the Anglican Church on the province.
