It is not strange that the deduction of laws from absolute principles should have usurped so much of their free energy. The American political mind had to live on its capital. In legalism it found a tested body of rules from which new rules could be spun without the labor of earning new truths from experience.

Tempted to "fall away," to give up the "hope set before them," to relapse to legalism, to bondage, to the desert, to a famine of the soul, to barrenness and death here they are dealt with, in order to the more than prevention of the evil.

In Justice the young advocate who appears for the defence is not so much pleading for the client under the law, as arraigning the present legal system, setting up a new conception of law based upon common sense, human insight, and a morality finer than legalism.

We have succumbed to the disease which has been called legalism the persuasion that the craving for individual initiative born of the unsettling of old faiths and the opening of new horizons, as well as the consequences of poverty, misery, ignorance, and hereditary incompetence that this vast turning of the human tide, manifesting itself in many forms, some benign, many evil that this broad and profound phenomenon can be met and controlled only by force, suppression, punishment, the infliction of physical pain and moral humiliation.

In some degree, the situation resembled that which existed in the Holy Roman Empire when a complicated legalism kept grinding away and pretentious forms of authority were maintained, although, meanwhile, there was actual administrative impotence. Striking evidence of the existence of such a situation is found in President Arthur's messages to Congress.

Be sure that the thing that God gives, the righteousness that is of God, is a real thing, and not a contemptible legalism. Pray God I have no righteousness imputed to me. Let me be regarded as the sinner I am; for nothing will serve my need but to be made a righteous man, one that will no more sin. We have the word imputed just once in the New Testament.

By 1855 and 1856 there was added to a recrudescence of this disorder a lawlessness of graft, of corruption, both political and financial, and the overbearing arrogance of a self-made aristocracy. These conditions combined to bring about a second crisis in the precarious life of this new society. The foundation of trouble in California at this time was formal legalism. Legality was made a fetish.

But it were better to hunger after righteousness for ever than to dull the sense of lack with the husks of the Christian scribes and lawyers: he who trusts in the atonement instead of in the father of Jesus Christ, fills his fancy with the chimeras of a vulgar legalism, not his heart with the righteousness of God. Hear another like word of the Lord.

Sin is, in fact, nothing else than this derangement or disturbance: it is that in which wrong is done to the moral constitution under which we live. And let no one say that in such an expression we are turning our back on the personal world, and lapsing, or incurring the risk of lapsing, into mere legalism again.

And when life is regulated by an elaborate Law, the rules of which are familiar to all men, there is no reason why a man's outward conduct should not be appraised, with some approach to accuracy, by his neighbours and friends. Hence it is that in the atmosphere of legalism an excessive deference is wont to be paid to public, and even to parochial, opinion.
