The Arsacidae had employed no gold coins, but had been content with a silver currency; any gold coin that may have been in use among their subjects for purposes of trade during the continuance of their empire must have been foreign money Roman, Bactrian, or Indian; but the quantity had probably for the most part been very small. It is probable that the payment was mostly made in aurei.
Nor was a word said about her beauty, though her eyes were blue and her neck slender and white; and her hair, which was of a pretty shade of gold, could not even be seen under that hideous, unbecoming hat. "Ten aurei shall we say?" said Hun Rhavas with remarkable want of enthusiasm; "kind sirs, is there no one ready to say fifteen? The girl might be taught to sew or to trim a lady's nails.
Others there had been earlier in the day her former companions in Arminius' household on whom the auctioneer had lavished torrents of eloquent praise, whom for the first bidding he had appraised at forty or even fifty aurei, the public being over willing to pay higher sums than those.
Conversely, if only seventyfive aurei are given in legacies, and before acceptance the inheritance is so much diminished in value, say by fire, shipwreck, or death of slaves, that no more or even less than seventyfive aurei are left, the legatees can claim payment of their legacies in full.
Of a truth there was no guarantee as to her health and a sick slave was a burden and a nuisance. "Ten aurei then," said Hun Rhavas raising the hammer, whilst with hungry eyes the mother watched his every movement. A few more seconds of this agonising suspense! Oh! ye gods, how this waiting hurts! She pressed her hands against her side where a terrible pain turned her nearly giddy.
The couriers who bring to Rome news of my father's death bid them hurry and take with them, also, word of the illness of that dog Vergilius. After they leave let him not linger in needless pain do you understand me? For that, I say, each of you shall have five thousand aurei added to his wealth." The others nodded.
"I've taken the titulus from off her neck and set the hat over her head, and that was difficult enough for the praefect's eyes are very sharp. Ten aurei should be the highest bid for a maid without guarantees as to skill, health or condition. And as she is not over well-favoured " But this the mother would not admit.
If a man stipulates for payment of ten aurei to himself and another who is not his paterfamilias, the contract will be good, though there has been much doubt whether in such a case the stipulator can sue for the whole sum agreed upon, or only half; the law is now settled in favour of the smaller sum.
Thus, if we suppose four hundred aurei to have been given in legacies, and the value of the inheritance, out of which they are to be paid, to be exactly that sum, each legatee must have his legacy abated by onefourth; if three hundred and fifty have been given in legacies, each legacy will be diminished by one-eighth; if five hundred, first a fifth, then a fourth, must be deducted: for when the amount given in legacies actually exceeds the sum of the inheritance, there must be struck off first the excess, and then the share which the heir is entitled to retain.
Thus, if it be a performance which is stipulated for, some such penalty should be added as in the following: 'If so and so is not done, do you promise to pay ten aurei as a penalty? And if the performance of some acts, and the nonperformance of others, are bargained for in the same stipulation, a clause of the following kind should be added, 'If any default is made, either as contrary to what is agreed upon, or by way of nonperformance, do you promise to pay a penalty of ten aurei?
