Two renegades were thus secured, and when the voting-day came, Trebellius, who was one of them, put in a veto; the other, Roscius, said that the power intended for Pompey was too considerable to be trusted to a single person, and proposed two commanders instead of one. The mob was packed so thick that the house-tops were covered.
At this time Tom Davies, the sometime Roscius, sometime bibliopole, stepped forward to Goldsmith's relief, and proposed that he should undertake an easy popular history of Rome in two volumes. An arrangement was soon made. Goldsmith undertook to complete it in two years, if possible, for two hundred and fifty guineas, and forthwith set about his task with cheerful alacrity.
There were in all eight legions, with part of another to be disposed of, and they were distributed in the following order. Lucius Roscius was placed at Seex, in Normandy; Quintus Cicero at Charleroy, not far from the scene of the battle with the Nervii.
Roscius, which was the first cause I pleaded, met with such a favourable reception, that, from that moment, I was looked upon as an advocate of the first class, and equal to the greatest and most important causes: and after this I pleaded many others, which I pre-composed with all the care and accuracy I was master of.
A thousand voices took up the cry "On your knees," and the English Roscius was obliged to kneel down and beg forgiveness. Then came a thunder of applause, and everything was over. Such are the English, and above all, the Londoners.
You remember what old Tully says in his oration, pro Archia poeta, concerning one of your confraternity quis nostrum tam anino agresti ac duro fuit ut ut I forget the Latin the meaning is, which of us was so rude and barbarous as to remain unmoved at the death of the great Roscius, whose advanced age was so far from preparing us for his death, that we rather hoped one so graceful, so excellent in his art, ought to be exempted from the common lot of mortality?
"Doubt now if you can, judges, by whom Roscius was killed: whether by him who, by his father's death, is plunged into poverty and trouble who is forbidden even to investigate the truth or by those who are afraid of real evidence, who themselves possess the plunder, who live in the midst of murder, and on the proceeds of murder."
Old Roscius had had two sons, of whom he had kept one with him in Rome the one, probably, whose society had been dearest to him. He, however, had died, and our Roscius Sextus Roscius Amerinus, as he came to be called when he was made famous by the murder was left on one of the farms down in the country.
Both had the privilege of Cicero's friendship; both no doubt lent him the benefit of their professional advice. The interchange of hints between an orator and an actor was not unexampled. When Hortensius spoke, Roscius always attended to study his suggestive gestures, and it is told of Cicero himself that he and Roscius strove which could express the higher emotions more perfectly by his art.
This is notable as having been spoken in behalf of that Roscius, the great comic actor, whose name has become familiar to us on account of his excellence, almost as have those of Garrick, of Siddons, and of Talma. It was a pleading as to the value of a slave, and the amount of pecuniary responsibility attaching to Roscius on account of the slave, who had been murdered when in his charge.
