Such a conception was absolutely worthless so far as most of the practical difficulties of the task were concerned; for, whether Jugurtha was an enemy or a rebel, he was equally difficult to secure; but it may have had a considerable influence on the principles on which the Numidian war was now to be conducted, and we shall find on the part of Rome a growing disinclination to give Jugurtha the benefits of those rules of civilised warfare of which she generally professed a scrupulous observance in the letter if not in the spirit.

It is not my design to betray you, now that you have conferred upon me a place of profit. You have committed to my conduct, the war against Jugurtha. The Patricians are offended at this. But, where would be the wisdom of giving such a command to one of their honourable body? a person of illustrious birth, of ancient family, of innumerable statues, but of no experience!

Marius reluctantly tolerated the assumption by his predecessor of the name of conqueror of Numidia; he flew into a violent rage when king Bocchus afterwards consecrated a golden effigy at the Capitol, which represented the surrender of Jugurtha to Sulla; and yet in the eyes of unprejudiced judges the services of these two threw the generalship of Marius very much into the shade more especially Sulla's brilliant expedition to the desert, which had made his courage, his presence of mind, his acuteness, his power over men to be recognized by the general himself and by the whole army.

His brother Mastanabal had left behind him an illegitimate son named Jugurtha.

These Imagines were carried in procession at funerals. They successively conducted the war against Jugurtha without success. At this time a great part of Germany was probably covered with forest. Cn. In B.C. 109 the consul M. Junius Silanus was defeated by the Cimbri, who demanded of the Roman Senate lands to settle in: the demand was refused.

It was vain to argue that, had we been the delinquents, we should scarcely have been standing there still, awaiting discovery. The idea of arguing with a rural policeman, when, by a rare coincidence, popular feeling is with him! The mob regarded our capture, exulting like the Romans over Jugurtha in chains. It was decided "we were to go before the Inspector."

Jugurtha submitted at discretion; but the victor was merciful and gave him back his kingdom undiminished, in consideration of his paying a moderate fine and delivering up the Roman deserters and the war elephants ; the greater part of the latter the king afterwards repurchased by bargaining with the individual Roman commandants and officers.

And meanwhile Jugurtha of Numidia had for long years bought every Roman general sent against him, had come to Rome himself and bought the laws, and had gone back to his country with contemptuous leave-taking 'Thou city where all is sold! And still he bought, till Caius Marius, high-hearted plebeian and great soldier, brought him back to die in the Mamertine prison.

He was succeeded by his son Micipsa, who in turn had two legitimate children, Hiempsal and Adherbal, and an illegitimate nephew Jugurtha, considerably older than his own boys, a young man of striking talent and promise. Micipsa, who was advanced in years, was afraid that if he died this brilliant youth might be a dangerous rival to his sons.

Caius Gracchus had wished to extend the Roman franchise to the Italian States, and the suggestion had cost him his popularity and his life. The Italian provinces had furnished their share of the armies which had beaten Jugurtha, and had destroyed the German invaders.
