Recent plays and magazine articles, with which most of our readers will be familiar, sufficiently bear out this point. In property rights, however, I can find no legislation which discriminates against the negro, and there is some in his favor. With the exception of the labor or peonage laws, discussed separately, I have found no legislation which limits his property or contract rights.
In obedience to the demands of an imperious, ever-rising, thermometer, we reduced our rig to the least possible articles consistent with decency and the regulations of the Service which latter, by the way, discriminates not between the caloric of the north pole and that of the equator. Just at this time, we encountered a phenomenon of frequent occurrence in this region, namely, water-spouts.
As a consequence of Section 2 of the tariff act of August 5, 1909, it becomes the duty of the Secretary of State to conduct as diplomatic business all the negotiations necessary to place him in a position to advise me as to whether or not a particular country unduly discriminates against the United States in the sense of the statute referred to.
The child perceives things, discriminates things, knows its mother from a stranger, is angry, or glad, or afraid, long before it has any language or any proper concepts. Animals know only through their senses, and this "knowledge is restricted to things present in time and space." Reflection, or a return upon themselves in thought, of this they are not capable.
But Chance, being witless, discriminates without trouble; and because she is blind, her arbitraments offend nobody's sensibility. Do you consent?" The two captains looked at the dice-box and nodded. "The conditions?" "One throw," said Captain Runacles. "And the highest cast to win," added Captain Barker. "You, Captain Barker, are the senior by a year, I believe. Will you throw first?"
Although the law has opened wide the door for all women to engage in business, it still discriminates in their favor in many particulars.
Such a companion in Venice should of course be of the sex that discriminates most finely. An intelligent woman who knows her Venice seems doubly intelligent, and it makes no woman's perceptions less keen to be aware that she can't help looking graceful as she is borne over the waves.
This unreasoning, impulsive, and irresponsible public never stops to inform itself; never discriminates between legal acumen and pettifogging trickery, between doing one's full duty to his client and interposing or misrepresenting his own personal opinions; and never remembers that the functions of law and the practice of law are to prevent and to punish crime, to ascertain the truth, and to determine and enforce justice, that trial by jury, and the other means and methods through which justice is administered, are founded in the largest wisdom, philanthropy, and experience, that they cannot work perfectly, because human nature is imperfect, but they constitute the best practical system for the application of abstract principles of right to the complicated affairs of life which the world has yet seen, and which steadily improves as our race improves, and that every great lawyer is aiding in elucidating truth and in administering justice, when doing his duty to his client under this system.
Moreover, he continues, "practically it discriminates against the best, and in favor of the worst; for, while the good man will be limited by his conscience to what the law allows, the bad man, free from moral check, will distribute his seed beyond the legal limits, as widely as he dares."
Morality is the corrector of these false valuatiens; it discriminates for us between real and counterfeit goods, teaches us to discount the pictures of our imagination and see the gnawed bones on the beach where the sirens sing. Our impulses often clash.
