Then there was a silence that seemed interminable, a gathering of two or three dark figures where a smoke-curl still lazily floated, and then the hurried, husky, panting voice of Col. Starbottle in his ear, "He's hit hard through the lungs you must run for it!"
Starbottle laid her weary head upon her pillow, she tried to picture to herself Carry at the same moment sleeping peacefully in the great schoolhouse on the hill; and it was a rare comfort to this yearning, foolish woman to know that she was so near.
Enough that, in the language of the plaintiff's counsel, "it was one of no ordinary significance, involving the inherent rights of that untiring industry which had developed the Pactolian resources of this golden land"; and, in the homelier phrase of Colonel Starbottle, "A fuss that gentlemen might hev settled in ten minutes over a social glass, ef they meant business; or in ten seconds with a revolver, ef they meant fun."
It was only broken by Colonel Starbottle: "Your duty commands you, sir, to use all possible diligence in bringing us before the Federal judge of this district unless your master in Washington has violated the Constitution so far as to remove him, too!"
That will be on your eighteenth birthday, the 20th, I think, of the present month." Carry was silent. "Pray do not think that I am here to receive your decision, even if it be already made. I only came to inform you that your stepmother, Mrs. Starbottle, will be in town to-morrow, and will pass a few days at the hotel.
Brown, very rosy, large-eyed, and pretty, sat upon the piazza, enjoying the fresh incense of the mountain breeze, and, it is to be feared, another incense which was not so fresh, nor quite as innocent. Beside her sat Colonel Starbottle and Judge Boompointer, and a later addition to her court in the shape of a foreign tourist. She was in good spirits.
The tin sign bearing the dazzling legend, "Starbottle and Bungstarter, Attorneys and Counselors," glowed with an insufferable light; the two pine-trees still left in the clearing around the house, ineffective as shade, seemed only to have absorbed the day-long heat through every scorched and crisp twig and fibre, to radiate it again with the pungent smell of a slowly smouldering fire; the air was motionless yet vibrating in the sunlight; on distant shallows the half-dried river was flashing and intolerable.
Starbottle, she raised Jack's hand to her feverish lips. "It cannot add to MY happiness now, Jack; but tell me, why did you keep it from her?" Jack smiled, but did not reply. Within the next week the necessary legal formalities were concluded; and Carry was restored to her stepmother. At Mrs.
"As far as I can follow the pleadings," said the Judge, gravely, "the case seems to be hardly one for litigation, and I approve of the defendant's course, while I strongly urge the plaintiff to accept it." Colonel Starbottle bent over his fair client. Presently he rose, unchanged in look or demeanor. "I yield, your Honor, to the wishes of my client, and er lady. We accept."
It was with some natural youthful curiosity, but no lack of loyalty to Colonel Starbottle, that the editor that evening sought this "war-horse of the Democracy," as he was familiarly known, in his invalid chamber at the Palmetto Hotel. He found the hero with a bandaged ear and perhaps it was fancy suggested by the story of the choking cheeks more than usually suffused and apoplectic.
