If we prefer, as I do, the humanity of Cicero, we must confess to ourselves the supremacy of Cæsar, and acknowledge ourselves to belong to the beaten cause. "Victrix causa Deis placuit; sed victa Catoni." In discussing the fate of these proconsular officials we feel now the absurdity of mixing together in the same debate the name of Piso and Gabinius with that of Cæsar.

The message ended by saying that the Proconsular Procurator, who came by the same carriages, would preside at the process. O wisdom of the world! and strength of the world! what are you when matched beside the foolishness and the weakness of the Christian? You are great in resources, manifold in methods, hopeful in prospects; but one thing you have not,—and that is peace.

He defended C. Calpurnius Piso also, who was accused, as were so many, of proconsular extortion; but whether in this year or in the preceding is not, I think, known. Of his speech on that occasion we have nothing remaining. Of his pleading for Murena we have, if not the whole, the material part, and, though nobody cares very much for Murena now, the oration is very amusing.

So the majority resolved on concession. Not from the people, which constitutionally ought to have been consulted in a case where a private man was to be invested with the supreme magisterial power, but from the senate, Pompeius received proconsular authority and the chief command in Hither Spain; and, forty days after he had received it, crossed the Alps in the summer of 677. Pompeius in Gaul

But upon casting my eye on the decree of the senate concerning cases of this nature, I find it only mentions the proconsular provinces.53 I have therefore, Sir, deferred interfering in this affair, till I shall receive your instructions as to how you would have me proceed.

The present is equally distressing. To think that this unhappy boy should have been so corrupted by you as to read aloud in the proconsular court, before a man of such lofty character as Claudius Maximus, a letter from his mother, which he chooses to regard as amatory, and in the presence of the statues of the emperor Pius to accuse his mother of yielding to a shameful passion and reproach her with her amours?

Honors were showered upon his head; he was made senator and pontifex; he received the proconsular power; there was talk of a marriage between him and the widow of Nero; and it was finally proposed that he be named consul for five years. Indeed, in 31, through the will of Tiberius, he actually became the colleague of the emperor himself in the consulate.

For Sicily, though but one province as regarded general condition, being under one governor with proconsular authority, retained separate modes of government, or, rather, varied forms of subjection to Rome, especially in matters of taxation, according as it had or had not been conquered from the Carthaginians.

Pompeius obtained neither free control over the treasury, nor legions and ships of his own, nor even an authority superior to that of the governors; but they contented themselves with granting to him, for the purpose of his organizing due supplies for the capital, considerable sums, fifteen adjutants, and in allaffairs elating to the supply of grain full proconsular power throughout the Roman dominions for the next five years, and with having this decree confirmed by the burgesses.
