The introduction of a new law with a new people at the Conquest had unsettled everything: for whilst some adhered to the Conqueror's regulations, and others contended for those of St. Edward, neither of them were well executed or properly obeyed. The king, therefore, with the assistance of his justiciaries, compiled a new body of laws, in order to find a temper between both.
If it has indeed been from the heights of our newly acquired consciousness that we have questioned ourselves, and condemned, they will not be menacing justiciaries whom we shall suddenly see surging in from all sides, but benevolent visitors, friends we have almost expected, and they will draw near us in silence.
The monks had become vast agricultural proprietors: 1,000 horses, 120 oxen, 200 cows, 300 bullocks, 300 hogs, 10,000 sheep were driven off for spoil, and as a last outrage, the granges and barns were burnt to the ground. £60,000, the justiciaries afterwards decided, would hardly cover the loss.
Few among the laity could even read; consequently the clergy alone were proper for public affairs. They were the statesmen, they were the lawyers; from them were often taken the bailiffs of the seigneurial courts, sometimes the sheriffs of counties, and almost constantly the justiciaries of the kingdom. If any complaint were made of a violation of the charter, whether attempted by the king, justiciaries, sheriffs, or foresters, any four of these barons might admonish the king to redress the grievance: if satisfaction were not obtained, they could assemble the whole council of twenty-five, who, in conjunction with the great council, were empowered to compel him to observe the charter, and, in case of resistance, might levy war against him, attack his castles, and employ every kind of violence, except against his royal person, and that of his queen and children.

The King Prince Edward was now at war with the barons, who had the King in their power revoked the grant of the Jews to his son; with that the grant to the Caorsini, which had not expired, was cancelled. The justiciaries appointed by the Prince to levy the tallage upon them were declared to have lost their authority; the Jews passed back to the property of the King.
It is not likely that the King redeemed the mortgage; but in 1261 they were again alienated to Prince Edward. The King's object was apparently by this and other gifts to withdraw the Prince from his alliance with the barons. The justiciaries of the Jews are now in abeyance. The chancellor of the exchequer was to seal ail writs of Judaism, and account to the attorneys of the Prince for the amount.
A Convocation was summoned at Perth for the election of these representatives, and a great judicial scheme which was promulgated in this assembly adopted the amended laws of King David as the base of a new legislation, and divided the country for judicial purposes into four districts, Lothian, Galloway, the Highlands, and the land between the Highlands and the Forth, at the head of each of which were placed two justiciaries, the one English and the other Scotch.
A writ was issued, addressed to the justiciaries who had presided at the trials for the adulteration of the coin, Peter of Pentecester, Walter of Heylynn, John of Cobham, appointed justiciaries for the occasion.
