But chance had lately presented the opportunity of making the interesting experiment of assimilating criminal jurisdiction in some of its branches to that of the civil courts. The president and jurors of one of the newly established quaestiones formed as isolated a group as the judex of civil justice with his assessors, or the greater panels of Centumvirs and Decemvirs.

For besides that there was no protection in the people, the right of appeal being done away with, they had also by mutual consent prohibited interference with each other: whereas the preceding decemvirs had allowed the points of law decided by themselves to be amended by appeal to a colleague, and had referred to the people some points which might seem to come within their own jurisdiction.

They secured the appointment of tribunes for their protection. Soon after they had the right of summoning before their own Comitia tributa any one who violated their rights. In 449 they had influence sufficient to establish the Connubium, by which they could intermarry with patricians. In 421 the plebeians were admitted to the quaestorship. Then, after a fierce contest, they were made decemvirs.

Lucius Sicinius Dentatus, one of the bravest, was sent out at the head of one army with some traitors, who, under orders from the decemvirs, murdered him in a lonely place. The other commander was Lucius Virginius, who will be known as long as literature lasts as father of the beautiful but unfortunate Virginia.

No new election of magistrates having taken place, private persons came forth as decemvirs, without any abatement either in their determination to enforce their authority, or any diminution in the emblems employed to make a parade of their station. This indeed seemed to be regal tyranny. Liberty is now deplored as lost for ever; nor does any champion stand forth, or appear likely to do so.

That either kings, or decemvirs, or, if there be any denomination of power more offensive, would be submitted to rather than see both the consuls patricians, or rather than not obey and rule in turn; but the one half, located in perpetual power, thinks the commons born for no other purpose than to be subservient."

Or, what is next to that, was it written in the twelve tables by the decemvirs, appointed to form a code of laws? Is it one, without which our ancestors thought that the honour of the female sex could not be preserved? and, therefore, have we also reason to fear, that, together with it, we should repeal the modesty and chastity of our females?

The imperial; it being the cruel decree of the emperor Domitian which banished him to the isle of Patmos where this vision was given. Kings, Consuls, Decemvirs, Dictators, and Triumvirs, were all in the past in John's day. Emperors were then ruling the Roman world; and the empire was still pagan.

There also, at the instance of Icilius and Numitorius, a secession from the decemvirs took place, men's minds being no less moved when they recalled to mind the murder of Siccius, than when they were fired with rage at the recent account of the disgraceful attempt made on the maiden to gratify lust.

In Massachusetts today, while, on the one hand, there are a great many rules which are quite sufficiently accounted for by their manifest good sense, on the other, there are some which can only be understood by reference to the infancy of procedure among the German tribes, or to the social condition of Rome under the Decemvirs.
