Divers merchants, planters, and others trading to America, the cities of London and Bristol, the merchants of Liverpool, and owners of sundry ships which had been seized by the Spaniards, offered petitions against the convention, by which the subjects of Spain were so far from giving up their groundless and unjustifiable practice of visiting and searching British ships sailing to and from the British plantations, that they appeared to have claimed the power of doing it as a right; for they insisted that the differences which had arisen concerning it should be referred to plenipotentiaries, to be discussed by them without even agreeing to abstain from such visitation and search during the time that the discussion of this affair might last.
Such inquiries as these will, in ordinary cases, bring to the teacher's knowledge, in most districts in our country, some cases of peculiarly troublesome scholars, or unreasonable and complaining parents; and stories of their unjustifiable conduct on former occasions will come to him exaggerated by the jealousy of rival neighbors.
Fish shows them apart from their connection, do very certainly seem in bad taste, if not actually indiscreet and unjustifiable. Let me give an example:
But the science of the modern school pretends merely to be a teaching of useful knowledge; the vistas, the tremendous implications of modern science are conscientiously disregarded, and it is in effect too often no more than a diversion of school energies to the acquisition of imperfectly analyzed misstatements about entrails, elements, and electricity, with a view a quite unjustifiable view to immediate profitable hygienic and commercial application.
And to-day there is a quite unjustifiable tendency to ignore the quality of the Arab and of his religion. Islam is an open-air religion, noble and simple in its broad conceptions; it is none the less vital from Nigeria to China because it has sickened in the closeness of Constantinople.
This saves neither time nor ink, and has an awkward sound besides. One often sees a remark like this in our papers: "MRS. Assistant District Attorney Johnson returned to her city residence yesterday for the season." That is a case of really unjustifiable compounding; because it not only saves no time or trouble, but confers a title on Mrs. Johnson which she has no right to.
This matter, you know, was spoken over some few years ago, and conditionally approved of by us both; but my son was then very young, and had not plunged into that course of unjustifiable extravagance and profligacy which, to my cost, has disgraced his latter years.
But though there is no reason to think that Essex had been murdered by any orders from court, it must be acknowledged that an unjustifiable use in Russel's trial was made of that incident. The king's counsel mentioned it in their pleadings as a strong proof of the conspiracy; and it is said to have had great weight with the jury. It was insisted on in Sidney's trial for the same purpose.
But these considerations do not diminish the credit of either admiral, though they help to explain the fullness of their success, and justify proceedings which under different circumstances would be unjustifiable. Rather, it may be said that, in the adaptation of their measures to the conditions opposed to them, what would otherwise invite condemnation as rashness, demands recognition as genius.
If she gives him up she will never care for anything again, and if she does not, she will have done an unjustifiable thing; and life after that for such a woman as Ideala would be like one of those fairy gifts which were bestowed subject to some burdensome condition that made the good of them null and void."
