And there is almost no record of an innocent man being hanged by lynchers in the West. For minor offences the penalty was to be marched out of camp, with a warning to be very cautious about coming that way again, but for graver ones it was death.

An hour before he had been in the "rat-trap" with a circle of lynchers around him, and only two terror-stricken guards to save him from the most horrible of deaths. Then came Fate and tore him away and gave him to the liberty of the boundless hills. Fate in the person of this slender, sombre man. He stared at Dan with awe.

He also knew how futile it was to argue with men whose passions were roused to the fighting pitch. The Colonel's interference was an instance of how little such men could be influenced. It was absurd to look for moderation under the circumstances. There was only one way to save the prisoner the use of the same means employed by the lynchers, namely, force. Whence could such interference come?

The "Vicksburg Sentinel," Sept. 28, 1837, says: "It is only a few weeks since humanity was shocked by a most atrocious outrage, inflicted by the Lynchers, on the person of a Mr. Saunderson of Madison, co. in this state.

But what thus lies beyond his talents as an individual at once becomes feasible when he joins himself with other men in a like situation. This is the genesis of a mob of lynchers. It is composed primarily of a few men with definite grievances, sometimes against the negro lynched but often against quite different negroes.

The contagion of indifference spread. The mob was melting. In the meantime one or two members of the Earp faction had procured a team and wagon. As soon as the lynchers had dispersed they stowed the prisoner in the vehicle, and set out for Tucson with a heavy guard. But there was no pursuit. The reaction which follows perfervid enthusiasm of this sort had settled down upon the miners and cow-boys.

"This is what's new. Whistlin' Dan Barry no less has busted open the jail at Elkhead an' set Lee Haines free." The sheriff could not speak. "I fixed it, Gus. I staged the whole little game." "You fixed it with Whistlin' Dan?" "Don't ask me how I worked it. The pint is that he did the job. He got into the jail while the lynchers was guardin' it, gettin' ready for a rush. They opened fire.

The group gathered around the bed were paralyzed to silence, but after a moment the silence was broken by the voice of the leader of the gang of lynchers who asked: "Who is he, Tom?" In clear distinct tones the answer came: "The villain who struck me down!" Renie uttered a scream, and oaths fell from the lips of the men.

Governor Vardaman of Mississippi, though a reactionary as to negro education, has struck terror to the hearts of the lynchers.

"But if we go after 'em in th' open an' th' daylight, they'll get a lot of us. We'll wait till night." "Suits me," said Walt Lampson. "I don't want no sheepman t' get me." There was a puff of smoke from the house, and a bullet whined over the men's heads. They dropped to the ground. The lynchers raised their rifles and emptied them, but not at the house.
