When the triumvirate was formed in 43, Pollio was made Antony's legatus in Cisalpine Gaul and promised the consulship for the year 40. After Philippi, however, in the autumn of 42, Cisalpine Gaul was declared a part of Italy and, therefore, fell out of Pollio's control.
Manius Acilius Glabrio, who was consul B.C. 191, defeated in that year Antiochus III. king of Syria, commonly called the Great, at Thermopylæ in Greece. Antiochus afterwards withdrew into Asia. C. Flavius Fimbria was the legatus of the consul L. Valerius Flaccus. It was equivalent to six Roman modii.

But Cato used Ennius as soldier while Nobilior employed him as poet. It is difficult, however, to fix the date of this enactment. Some authorities place it after Cato's return from Spain. Livy 34, cc. 1-8. See Livy, 34, 18. i.e. he was legatus consularis. It was at the time a common thing for ex-consuls to take service under their successors. So Liv. 36, 17, 1, but Cic. Cat.
The consuls who were elected for the year B.C. 61, were M. Pupius Piso, who had been a legatus of Pompeius in Asia, and M. Valerius Messalla. The story is told in the Life of Marius, c. 29. Aulus Gabinius, when Tribunus Plebis B.C. 67, proposed the law which gave Pompeius the command against the pirates.

During this year, in which Octavian had to besiege Lucius Antony at Perusia, Pollio, a legatus of Mark Antony, was naturally not on good terms with Octavian, and could hardly have used any influence in behalf of Vergil or any one else. After the Perusine war he joined Antony at Brundisium in the spring of 40, and acted as his spokesman at the conference which led to the momentous treaty of peace.
