Indeed, Sir, allow me to ask again, if the national judiciary was not to exercise a power of revision on constitutional questions over the judicatures of the States, why was any national judicature erected at all?
Arabinus non solum vivit, sed in senatum venit. Ah! Arabinus not only liveth, but he is in the senate. Out of just indignation, he could not endure to see him. As all are not meet for places of trust in judicatures, so all are not meet for places of trust in armies. Men should be chosen who are godly, and able for the charge. But there are some who are not meet for trust. 1.
And then there's Aily MacClure of Deepheugh, that practises her abominations, spacing folks' fortunes wi' egg-shells, and mutton-banes, and dreams and divinations, whilk is a scandal to ony Christian land to suffer sic a wretch to live; and I'll uphaud that, in a' judicatures, civil or ecclesiastical."
She opened the door without any trouble. They were inside, within the pale-sheeted interior. Scarcely a thing had yet been moved, for, with the formalities of the judicatures of France, England, and the State of Indiana to be complied with, events marched slowly under the sticky manipulation of three different legal firms.
The evil complained of, or the danger to be guarded against, was contradiction and repugnance in the decisions of these judicatures.
The real object of inquiry to human judicatures is the internal disposition; it is to this that they adapt the nature, and proportion the degree, of their punishments.
Without the royal sanction her canons had no force. One of the articles of her faith was that without the royal consent no ecclesiastical council could lawfully assemble. From all her judicatures an appeal lay, in the last resort, to the sovereign, even when the question was whether an opinion ought to be accounted heretical, or whether the administration of a sacrament had been valid.
It is Folly that, in a several dress, governs cities, appoints magistrates, and supports judicatures; and, in short, makes the whole course of man's life a mere children's play, and worse than push-pin diversion.
Have those who say so looked at the expenses of the National Assembly itself? of the municipalities? of the city of Paris? of the increased pay of the two armies? of the new police? of the new judicatures? Have they even carefully compared the present pension-list with the former? These politicians have been cruel, not economical.
We serve an all-merciful Being, who knows the frailty of our nature, the number and strength of our temptations, and will not be extreme to mark what is done amiss. Even the less lenient judicatures of human institution concede somewhat to the weakness of man. It is an established maxim 'De minimis non curat lex. We hope we are not worse than the generality. All men are imperfect.
