Still the minds of Liverpool, Ellenborough, and Sir William Scott, judge of the court of admiralty, were not altogether easy on the legal aspect of the case, which Eldon reviewed in an elaborate and exhaustive memorandum.
Why, Sir, undoubtedly, if it is to be taken for granted that Lord Ellenborough is a perfect man, if all our reasonings are to proceed on the supposition that he cannot do wrong, then I admit the force of the honourable gentleman's argument. But it seems to me a strange and dangerous thing to infer a man's innocence merely from the flagrancy of his guilt.
That sort of argument, too frivolous and faulty, it might be supposed, to influence any one, had weight with the House of Commons to which it was addressed; and the Solicitor-General adduced much more of it. As Lord Ellenborough said in the decision quoted by the Chief Justice himself: "Every man may fix what price he pleases upon his own property, or the use of it; but if for a particular purpose the public have a right to resort to his premises and make use of them, and he have a monopoly in them for that purpose, if he will take the benefit of that monopoly, he must, as an equivalent, perform the duty attached to it on reasonable terms."
The press was rude; Lord Ellenborough attacked the Queen in the House of Lords; there were curious whispers in high quarters that she had had thoughts of abdicating whispers followed by regrets that she had not done so. Lord Cochrane thereupon tendered to the House thirteen charges against Lord Ellenborough, in which every point of importance in the Stock Exchange trial was minutely detailed and discussed; and these charges being read, therein occupying nearly three hours, were ordered to be printed.
