While this order, which was thus given for the double purpose of enabling the victors to get between the tories and their guns, and to give time for Pettibone and his associate to come up, was being carried into effect, Bart, who had been burning with impatience for a chance to go to the assistance of his endangered friend.

When he returned to the mansion-house, at ten, Richard and the Major were still seated at the table. They at tempted to persuade the Gaul, as the sheriff called him, that he should next try Remarkable Pettibone.

A jury, however, Eli Pettibone, Esq., presiding as civil magistrate, was allowed the prisoner; when, more probably, from sympathy for the manly but misguided young officer, whom they had known as a pleasant neighbor, than from want of proof, he was acquitted as a spy, and, with the rest of his band, removed to Northampton jail as prisoner of war.

The Legislature of Nevada was in sympathy with, or at least was afraid of not expressing sympathy for, Messrs. Moyer, Haywood, Pettibone, and their associates. The State was practically without any police, and the Governor had recommended the establishment of a State Constabulary, along the lines of the Texas Rangers; but the Legislature rejected his request.

Though I know, 'cordin' to all white folks' way o' tinkin', dar a'n't no hope, 'cause Squire Marvyn he had dat ar Jeduth Pettibone up to his house, a-questionin' on him, off an' on, nigh about tree hours. An' r'ally I didn't see no hope no way, 'xcept jes' dis yer, as I was tellin' Cato, I can't feel it in my bones."

The instant that Remarkable Pettibone had executed her portion of the labor in illuminating, she returned to a position near Elizabeth, with the apparent motive of receiving the clothes that the other threw aside, but in reality to examine, with an air of curiosity not unmixed with jealousy the appearance of the lady who was to supplant her in the administration of their domestic economy.

She presided over the female part of the domestic arrangements, in the capacity of housekeeper; was a spinster, and bore the name of Remarkable Pettibone. To Elizabeth she was an entire stranger, having been introduced into the family since the death of her mother.

Some of these victims were crippled for life and died as a result thereof. When it became known that the W. F. M. continued to stand erect, regardless of brutal attacks, it was decided to strike the last violent blow against it. Orchard, the man of honor, confessed, and the lawbreakers appealed to the law against Haywood, Moyer and Pettibone. This time the government did not hesitate.

"S'pose you've heerd the news that Jeduthun Pettibone brought home in the 'Flying Scud, 'bout the wreck o' the 'Monsoon'; it's an awful providence, that 'ar' is, a'n't it? Why, Jeduthun says she jest crushed like an egg-shell"; and with that Amaziah illustrated the fact by crushing an egg in his great brown hand. Mary did not answer.

There was, at that time, repeated and angry denial of the truth of his story; and, since the acquittal of W. D. Haywood, secretary and treasurer of the Western Federation of Miners, and of George A. Pettibone, whom Orchard charged with being the instigators of his crimes, their adherents have, of course, maintained that Orchard's story has been entirely disproved. Logically, this does not follow.
