Every American shipowner felt the difference, and remembered it. With Spain the United States was less successful. The West was thus seething with separatist agitations throughout the time of Gradoqui's residence as Spanish Envoy in America; and both Gardoqui and Miro, who was Governor of Louisiana all through these years, entered actively into intrigues with the more prominent separatist leaders. Shortly after his return to America he was made Secretary of Foreign Affairs, and was serving as such when, in the spring of 1785, Don Diego Gardoqui arrived in Philadelphia, bearing a commission from his Catholic Majesty to Congress.
Although Sevier was forbidden to hold office under the state, the passage of this act automatically operated to clear him of the alleged offense of high treason. With affairs in Franklin taking this turn, it is little wonder that Gardoqui and Miro paid no further heed to Sevier's proposal to accept the protection of Spain.
He absolutely refused to surrender our right to navigate the Mississippi; but, not regarding it as of immediate consequence, he proposed both to Congress and Gardoqui that in consideration of certain concessions by Spain we should agree to forbear to exercise this right for twenty or twenty-five years.
Alarmed early in the year over the unprovoked depredations and murders by the Indians in several Tennessee counties and on the Kentucky road, Sevier, Robertson, and Anthony Bledsoe had persuaded Governor Samuel Johnston of North Carolina to address Gardoqui and request him to exert his influence to prevent further acts of savage barbarity.
Gardoqui offered in substance to make a commercial treaty provided the United States would surrender the claim to navigate the Mississippi for twenty years. Jay, to whose mind the interests of the seaboard shipowners and producers far outweighed the desires of the few settlers of the interior waters, was willing to make the agreement.
