His rival Capito was equally learned in all departments of the law, and left behind him as many treatises as Labeo. These two jurists were the founders of celebrated schools, like the ancient philosophers, and each had distinguished followers.

A zealous advocate of humanism, he had attempted, as early as 1503, to reform the clergy of his bishopric by means of synodal statutes, without much success; afterwards he had called scholars like Oecolampadius, Capito and Wimpfeling to Basle. That was before the great struggle began, which was soon to carry away Oecolampadius and Capito much further than the Bishop of Basle or Erasmus approved.

In spite of the great expectations he cherished of classical studies for pure Christianity, he saw one danger: 'that under the cloak of reviving ancient literature paganism tries to rear its head, as there are those among Christians who acknowledge Christ only in name but inwardly breathe heathenism'. This he writes in 1517 to Capito.

"I assumed all that," I interrupted, "but I cannot conceive why he has talked to you about it." Capito was always ingratiating. He gazed at me reproachfully, gently, winningly. "If I have your permission," he said, "I shall explain." "Explain!" I cried impatiently. "Agathemer," he went on, "has left no stone unturned to find some means for placating both clans and for reconciling you with both.

When Capito had selected a pair of swords which suited both him and the Emperor, he went off to change. While he was gone Commodus had the armorer drill a tiny hole near the point of one sword and insert in it one of those thorn-like little steel points which are commonly used on the ends of donkey-goads. When Capito returned he showed him the two swords.

Suspicion attacked even the supernatural origin of the Penguins. The historian Ovidius Capito went so far as to deny the miracle of their transformation. He thus begins his "Annals of Penguinia": "A dense obscurity envelopes this history, and it would be no exaggeration to say that it is a tissue of puerile fables and popular tales.
