There are very important subjects in which we wish to examine you; especially the danger, if not the illegality, of attempting by new legislation to create a new Appellate Jurisdiction for the Colonies. From Mr. E. Twisleton 3 Rutland Gate, June 6th Dear Reeve, I send you herewith Francis's translation of Pinto on Credit, together with the original French work of Pinto.
The judicial power was vested in a Supreme Court with original jurisdiction in all cases affecting ambassadors and consuls and where the Republic is a party, and appellate jurisdiction in all other cases; and in subordinate courts to be established by the Legislature.
Under his imperturbable guise he found himself stunned. Burton turned to the attorney. "You know G.K. Hendricks?" Mr. Ruferton's answer followed the question with no margin of a pause. "State senator for three terms. At present candidate for the appellate bench; Tammany's choice. Was very valuable when the charter of Coal and Ore was before the assembly.
They would have to disentangle the mesh of evidence and find out whether that important piece of testimony on page 204 was excepted to or not, then whether there was a proper ruling; refer to the stenographer's minutes and look at the important exception on page 59 and again on page 106. Unless the question decided was excepted to, the Appellate Court can not decide it.
"He stated that, as the petitioner was the agent of a foreign power, and applied to Congress as an appellate power over the Executive, he thought it improper that he should be thus heard." And the question was decided upon this single point. I heartily approve the remarks then made by a distinguished statesman, now no more, who at that time represented Massachusetts on this floor. Mr.
A never-ending stream of peculiar cases flowed through the office, each leaving behind it some residuum of golden dust, however small. The stately or, as an unkind observer might have put it, the ramshackly form of the senior partner was a constant figure in all the courts, from that of the coroner on the one hand to the appellate tribunals upon the other.
The salaries for the highest trial court generally closely approximate those paid to the judges of the Supreme Court, and in case of trial courts held in large cities are often greater. Those for the inferior courts are much lower. The trial judges in Chicago also receive $10,000, although the highest appellate judges in the State have a salary of only $7,000.
The same reasons, if in less degree, support a liberal right of appeal in cases involving property only, and oppose restrictions based only on the amount in controversy. Americans could never tolerate keeping their appellate courts for the trial of large causes only. There must be no rich men's courts.
Shortly before the date set for the execution, another man turned up who admitted that he had committed the crime and made the fullest sort of a confession. A new trial was thereupon granted by the Appellate Court, and the convict, on the application of the prosecuting attorney, was discharged and quickly made himself scarce.
He may appeal from the decision or judgment and the appellate court may rule that the trial judge was wrong and then after an interval the case goes to a new trial just the same. By this time the plaintiff or his lawyer may believe he has no case and desists, but the course depends upon whether the parties have not died, grown tired, gone into the hands of a receiver, or moved to Borneo.
