AELIUS: his cognomen was Paetus; he was consul in 198, and censor in 194 B.C. He was one of the earliest and most famous writers on Roman Law. Lucius Lentulus, consul of the preceding year, was continued in command, and was ordered not to depart from the province, nor to remove the old army, until the consul should arrive with the new legions. The consuls cast lots for the provinces, and Italy fell to Aelius, Macedonia to Quintius.

Three pontiffs were also created, Quintus Caecilius Metellus, Quintus Fabius Maximus, and Quintus Fulvius Flaccus, in the room of Publius Scantinius deceased, and of Lucius Aemilius Paulus the consul, and of Quintus Aelius Paetus, who had fallen in the battle of Cannae.
Assemblies of any kind were prohibited by the new governor; but the law of Aelius Marcianus allowed gatherings for religious purposes, and the learned lawyer, Johannes, directed his fellow-Christians to rely on that. His diction is hardly varied enough to admit of clear reference to a standard, but on the whole it may be pronounced nearer to the silver than the golden Latinity, especially in the frequent use of abstract words. A poet whose misfortunes were of service to his talent, was POMPONIUS SECUNDUS. His friendship with Aelius Gallus, son to Sejanus, caused him to be imprisoned during several years.
This courtier-like counsel is characteristic of the man, and helps to explain the high position he was enabled to take under the empire. Two other jurists are worthy of mention, A. Cascellius, a contemporary of Trebatius, and noted for his sarcastic wit; and Q. Aelius Tubero, who wrote also on history and rhetoric, but finally gave himself exclusively to legal studies.
Of the daughters of Aemilius, one was married to the son of Cato, the other to Aelius Tubero, a most worthy man, and the one Roman who best succeeded in combining liberal habits with poverty.
