When a great part of the commonalty was grown cool, and it appeared from their orderly and peaceful behavior that they had been very much appeased by what they had heard, the tribunes, standing up, declared, in the name of the people, that since the senate was pleased to act soberly and do them reason, they, likewise, should be ready to yield in all that was fair and equitable on their side; they must insist, however, that Marcius should give in his answer to the several charges as follows: first, could he deny that he instigated the senate to overthrow the government and annul the privileges of the people? and, in the next place, when called to account for it, did he not disobey their summons? and, lastly, by the blows and other public affronts to the Aediles, had he not done all he could to commence a civil war?

We have seen that the people themselves in 186 were able and willing to contribute; and now it was possible for aediles to invest their capital in popular undertakings which might, later on, pay them well by carrying them on to higher magistracies and provincial governorships, where fresh fortunes might be made.

The aediles had charge of the public buildings and the games and exhibitions in the capital. The aedileship was a magistracy through which it was ordinarily necessary to pass in order to reach the consulship; and as the aediles were expected to bear their own expenses, the consulship was thus restricted to those who could afford an extravagant outlay.

The bulk of them had been sent to the markets of Delos and Phaselis, but the imperator had had the most valuable items amongst the human goods set aside for himself, and not a few choice pieces had found their way into the households of the aediles in charge of the sales: the State too had appropriated some hundreds of useful scribes, sculptors and mechanics, but there were still a thousand or so who in compliance with the original imperial edict would have to be sold by public auction in Rome for the benefit of the late censor's defrauded victims.

It happened that both the curule aediles, who had been created at the elections, were persons who could not immediately undertake the office: for Caius Cornelius Cethegus was elected in his absence, when he was occupying Spain as his province; and Caius Valerius Flaccus, who was present, being flamen Dialis, could not take the oath of observing the laws; and no person was allowed to hold any office longer than five days without taking the oath.

Then was held the election of praetors. The persons chosen were, Lucius Cornelius Merula, Marcus Claudius Marcellus, Marcus Porcius Cato, and Caius Helvius, who had been plebeian aediles. By these the plebeian games were repeated, and, on occasion of the games, a feast of Jupiter was celebrated.

Those senators, whose age and health permitted them, personally discharged the duty of sentinels. The patrol and general supervision was assigned to the plebeian aediles: on them devolved the chief conduct of affairs and the majesty of the consular authority.

The second is altogether unbeautiful, and we wonder why such a work should ever have been undertaken at all. Far better to have left the cathedral one- towered, as those of Sens and Auxerre. The town itself would be pleasant enough if its aediles were more alive to the importance of sanitation. It never seems to occur to the authorities in these regions to have the streets scoured and swept.

But the usual way of supplementing it was for the magistrate in charge of the ludi to pay what he could out of his own purse, or to get his friends to help him; and as all the ludi except the Apollinares were in charge of the aediles, it became the practice for these, if they aspired to reach the praetorship and consulship, to vie with each other in the recklessness of their expenditure.
