Returning last night from his presence, and passing through the thicket, I overheard voices at hand. I caught the name of Pausanias. 'The Spartan, said one voice, 'nightly visits the house of Diagoras. He goes usually alone. From the height near the temple we can watch well, for the night is clear; if he goes alone, we can intercept his way on his return. 'To the height! cried the other.

It was in one of the villas we have described, the favourite abode of the rich Diagoras, and in an apartment connected with those more private recesses of the house appropriated to the females, that two persons were seated by a window which commanded a wide view of the glittering sea below.

The date of this trial is not known for certain; but it is reasonably supposed to have coincided with that of Diagoras, namely, in 415. At any rate it must have taken place after 423-421, as we know that Protagoras was at that time staying in Athens.

This looks very plausible, and is interesting in so far as it, if correct, affords an instance of atheism arising in a layman from actual experience, not in a philosopher from speculation. If we ask, however, what is known historically about Diagoras, we are told a different tale.

That Spartan spoke well, who, when Diagoras, the Olympic victor, was looking at his sons being in their turn crowned as victors at Olympia, with his grandchildren about him, embraced him and said, "Die, Diagoras; for you cannot rise to Olympus and be a god there."

But for our purpose, at any rate, nothing remains of the copious mass of legend but the fact that one Diagoras of Melos in 415 was outlawed in Athens on the ground of his attack on the Mysteries. Such an attack may have been the outcome of atheism; there was no lack of impiety in Athens at the end of the fifth century.

Thus we arrive at the following list, in which those who were denoted as atheoi are italicised and those who were accused of impiety are marked with an asterisk: Xenophanes. *Anaxagoras. At another time, he himself was in a storm, when the sailors, being greatly alarmed, told him they justly deserved that misfortune for admitting him into their ship; when he, pointing to others under the like distress, asked them "if they believed Diagoras was also aboard those ships?" In short, with regard to good or bad fortune, it matters not what you are, or how you have lived.

Pausanias, surprised and moved by the burst of the fair Byzantine, gazed at her admiringly, and thought within himself how harshly the same sentiment would have sounded on the lips of a tall Spartan virgin; but when Cleonice heard the approving interlocution of Diagoras, her enthusiasm vanished from her face, and putting out her lips poutingly, she said, "Nay, father, I repeat only what others say of the Spartans.

That speech of the Lacedæmonian seems to have the same meaning, who, when Diagoras the Rhodian, who had himself been a conqueror at the Olympic games, saw two of his own sons conquerors there on the same day, approached the old man, and, congratulating him, said, "You should die now, Diagoras, for no greater happiness can possibly await you."
