We had already taken our farewell three times, and on each occasion we have come back again to our billets before the day that saw our departure came to an end. The heart of every man thrilled with excitement when the announcement was made for the first time, one weary evening when we had just completed a ten-hour divisional field exercise.

Besides Philadelphia and New York the mechanics secured the ten-hour day in Baltimore and Annapolis, but in the District of Columbia and elsewhere they were still working twelve or fourteen hours. In other words, the ten-hour day was secured only where trade societies existed. But the organized labor movement did not rest with a partial success. The campaign of pressure on the President went on.

Muller was that the Oregon Ten-Hour Law was unconstitutional: First, because the statute attempted to prevent persons from making their own contracts, and thus violated the provisions of the Fourteenth Amendment. Next, because the statute did not apply equally to all persons similarly situated and was class legislation.

Only slowly are laws being enacted to limit the hours of working women, yet the able brief presented to the United States supreme court on the constitutionality of the Oregon ten-hour law for women, based its plea upon the results of overwork as affecting women's health, the grave medical statement constantly broken into by a portrayal of the disastrous effects of over-fatigue upon character.

Julia was on her feet for ten hours or so a day. When you subject your feet to ten-hour tortures you are apt to pass by French-heeled effects in favour of something flat-heeled, laced, with an easy, comfortable crack here and there at the sides, and stockings with white cotton soles.

The doubt of its constitutionality proved an obstacle too grave for the friends of the workers to overcome. It was decided to substitute a ten-hour bill, an exact duplicate of the "Oregon Standard" established by the Supreme Court of the United States.

John Wanamaker, for instance, gets a hundred miles of travel per day out of some of his delivery-wagons. The average five-ton truck, in a ten-hour day, can make eighty miles, and keep constantly at work. On the other hand, a one-horse wagon can scarcely average half that mileage. Already your doctor whirls around in an automobile, and he can make five times more visits than with a horse.

An excellent illustration of how business can and does adjust itself to meet changing legal demands is seen in what happened when the Ten-Hour Law came in force in the state of Illinois in July, 1909.

Mercantile establishments came in under the amended Ten-hour Law two years later. The new law was, on the whole, wonderfully well observed in Chicago, and as far as I have been able to learn, in the smaller towns as well. There were some violations discovered, and plenty more, doubtless, remained undiscovered.

The unit costs in the report of 1906 are identical with those in the report of 1901, and since 1906 there has been an increase in the wage scale and in the cost of material. On the Isthmus wages exceed those in the United States from 40 to 80 per cent. for the same class of labor. The original estimates were based on a ten-hour day, but Congress imposed the eight-hour day.
