That term includes a "statutory power of decision". Since liberalizing amendments made in 1977, "statutory power" includes power conferred by or under any Act "to make any investigation or inquiry into the rights, powers, privileges, immunities, duties, or liabilities of any person" and "statutory power of decision" includes power conferred by or under any Act "to make a decision ... affecting" any such rights, powers, privileges, duties or liabilities.
This means inter alia that statutory-powers of summoning witnesses and requiring the production of documents apply, that a Judge of the High Court acting as Commissioner has the ordinary judicial immunity, and that interested persons have statutory rights to be heard under s. 4A, inserted by an amendment made in 1980 shortly before the inquiry now in question began.
These primitive schools made the children of every neighborhood familiar to each other, and encouraged a homogeneous feeling in the rising population of the State. But it is unlikely that such methods will extend beyond the larger privately owned vessels. Any attempt to revive in this way the old picaresque methods could only amount to a virtual repudiation of statutory international law, which would bring its own retribution. Moreover, for home waters at least, the conditions which favoured this picaresque warfare no longer exist.
Such of the gentry as acceded to these doctrines were not always, however, in a situation to be ruled by them. The commands of the law were imperative; and the privy council, who administered the executive power in Scotland, were severe in enforcing the statutory penalties against the crown-vassals who did not appear at the periodical wappen-schaw.
