His wishes were realized at last by the issue in May of a writ from the Exchequer, calling on him to show cause why payment of ship-money for his lands should not be made. The news of Hampden's resistance thrilled through the country at a moment when men were roused by news of resistance in the north.
When an arbitrary imposition is attempted upon the subject, undoubtedly it will not bear on its forehead the name of Ship-money. There is no danger that an extension of the Forest laws should be the chosen mode of oppression in this age.
All these had felt the oppression of monopolies and ship-money; to the patriots they were indebted for their freedom from such grievances; and, as to them they looked up with gratitude for past benefits, Sidney Papers, ii. 667. Whether the cipher 243 is correctly rendered "papists," I know not.
But thanks to parliamentary patriotism, the people of England were saved from ship-money, which money the wealthy paid, and only got in its stead the customs and excise, which the poor mainly supply. Rightly was King Charles surnamed the Martyr; for he was the holocaust of direct taxation.
From that time to 1815 no remonstrance was made against the transfer of territories in the West Indies and Caribbean Sea from one belligerent to another an indifference which scarcely would be shown at the present time, even though the position immediately involved were intrinsically of trivial importance; for the question at stake would be one of principle, of consequences, far reaching as Hampden's tribute of ship-money.
It was a revolution small in size; but great politically; it was a strike for liberty, a struggle for a principle, a stand against injustice and oppression. It was the Barons and John, over again; it was Hampden and Ship-Money; it was Concord and Lexington; small beginnings, all of them, but all of them great in political results, all of them epoch-making.
The ship being searched by spies of Laud, Oliver and John were put ashore and ordered to make haste to their country houses and stay there and cultivate the soil. The King and his Archbishop made a slight lapse in not allowing Oliver and John to depart in peace. When John Hampden refused to pay ship-money, Laud wanted him publicly whipped.
That the senate, sir, and not the judges, is now applied to, is no proof of the validity of the arguments which have been produced; for in the days of ship-money, the consent of the senate had been asked, had there been any prospect of obtaining it; but the court had been convinced, by frequent experiments, of the inflexibility of the senate, and despaired of influencing them by prospects of advantage, or intimidating them by frowns or menaces.
Noy devised the ship-money scheme, and then died before his law went into effect: killed by the hand of Providence, the Puritans said, who uttered prayers of thankfulness for his taking off, all of which was quite absurd, since the law lives, no matter who devised it. Rulers who wish to tax their subjects heavily should do it by indirection say by means of the tariff.
