The arguments used by both the gentlemen I have named prove very clearly that South Carolina and her sister States had no right to secede under the Constitution; that is to say, that it was not open to them peaceably to take their departure, and to refuse further allegiance to the President and Congress without a breach of the laws by which they were bound.
Here, where there was nobody to grumble or secede, Congress, in 1787, proceeded to carry out the work which Jefferson had outlined three years before. It is interesting to trace the immediate origin of the famous Ordinance of 1787.
But the opposition was now much stronger and more violent than formerly; so much so that Sir James Craig, the Canadian governor, actually despatched a spy, John Henry, to sound the willingness of New England, where the federalist party was the stronger, to secede from the union and join Great Britain against the United States.
In 1832, when I was in college, South Carolina was ready to Nullify or Secede from the Union on this account. And what have we seen? The Tariff no longer distracts the public counsels. Reason has triumphed! The present Tariff was voted for by Massachusetts and South Carolina.
Now she must either remain in a Union, where our institutions were to be dragged down; where the laws were to be obeyed in one section, but not in another; where existed open resistance to laws in one State and quiet obedience in another; where servile insurrections were being threatened continuously; where the slaves were aided and abetted by whites at the North in the butcheries of their families; or secede and fight.
On the 5th of December, 1857, John B. Floyd, then Secretary of War, in his report to James Buchanan, President of the United States, states that the people of Utah implicitly obeyed their prophet, and that from the first day of their settlement in the territory it had been their aim to secede from the Union.
He did this in the hope of thereby conciliating Spain to make a commercial treaty which he thought was far more important than shipping. Our people in the Southwest, however, regarded the closing of the river as portending their ruin, and they threatened to secede if it were persisted in. Pennsylvania and New Jersey threw their weight with the Southerners and Congress voted against the Jay treaty.
And if there ever was an object which, by its bare announcement, stamped rebels against a particular community as enemies of mankind, it is the one professed by the South. Their right to separate is the right which Cartouche or Turpin would have had to secede from their respective countries, because the laws of those countries would not suffer them to rob and murder on the highway.
Clingman, of North Carolina, opening the debate, predicted that the same political organization which had elected Lincoln must soon control the entire Government, and being guided by a sentiment hostile to the Southern States would change the whole character of the Government without abolishing its forms. A number of States would secede within the next sixty days. Mr.
That ex-President John Tyler is hereby appointed, by the concurrent vote of each branch of the general assembly, a commissioner to the President of the United States, and Judge John Robertson is hereby appointed, by a like vote, a commissioner to the State of South Carolina and the other States that have seceded or shall secede, with instructions respectfully to request the President of the United States and the authorities of such States to agree to abstain, pending the proceedings contemplated by the action of this general assembly, from any and all acts calculated to produce a collision of arms between the States and the Government of the United States.
