There was the chief pontiff, P. Licinius Crassus Mucianus, the man who was said to combine in a supreme degree the four great blessings of wealth, birth, eloquence and legal lore; there was the brother of Crassus, P. Mucius Scaevola, the greatest lawyer of his age and already destined to the consulship for the following year; lastly there was Tiberius's father-in-law, the restless Appius, now eagerly awaiting the fulfilment of a cherished scheme by the man of his own choice.
Suspected patricians were murdered: among them fell the Pontifex Maximus, the venerable Scaevola. At length the contest ended in a desperate fight under the walls of Rome itself on the 1st of November, B.C. 82. The battle began at four in the afternoon, and lasted through the night to the dawn of the following day.
If Gracchus still needed a special summons to carry his resolution into effect, he found it in this state of matters which filled the mind of every patriot with unspeakable anxiety. His father-in-law promised assistance in counsel and action; the support of the jurist Scaevola, who had shortly before been elected consul for 621, might be hoped for.
Lycurgus, Solon, Miltiades, Manlius Torquatus, Brutus, Mucius Scaevola, even the fabulous Minos himself, became as familiar in the tribune as in the theatre, and the public went crazy over them. The shades of the heroes of antiquity hovered over the revolutionary assemblies. Posterity alone has replaced them by the shades of the philosophers of the eighteenth century.
It was carried on more especially by two men of the highest character, Q. Mucius Scaevola, Cicero's adviser in his early days, and often his model in later life; and Servius Sulpicius Rufus, his exact contemporary and lifelong friend.
Accordingly, what common hearer who was present when Q. Scaevola pleaded for M. Coponius, in the cause above- mentioned, would have wished for, or indeed thought it possible to find any thing which was more correct, more elegant, or more complete?
The party of the aristocracy friendly towards reform, which openly favoured the distribution of the domains headed by Quintus Metellus, just about this time censor, and Publius Scaevola in concert with the party of Scipio Aemilianus, which was at least not disinclined to reform, gained the upper hand for the time being even in the senate; and a decree of the senate expressly directed the triumvirs to begin their labours.
Even his brother Publius Mucius Scaevola, the founder of scientific jurisprudence in Rome, seemed not averse to the plan of reform; and his voice was of the greater weight, as he stood in some measure aloof from the parties.
But in the midst of this Dudleigh stood as rigid as Mucius Scaevola under another fiery trial, with the hand that held the glowing iron and the arm that felt the awful torment as steady as though he had been a statue fashioned in that attitude. Thus he finished his work. It was all over in a few seconds.
SCAEVOLA. This will indeed be very gratifying to me, and had not Fannius anticipated me, I was about to make the same request. You thus will bestow a great kindness on both of us. LAELIUS. I certainly would not hesitate, if I had confidence in my own powers; for the subject is one of the highest importance, and, as Fannius says, we are at leisure.
