Opimius, immediately seizing the occasion thus offered, was in great delight, and urged the people to revenge; but there happening a great shower of rain on a sudden, it put an end to the business of that day.

The consul Lucius Opimius took his measures to put down by force of arms the insurrection for the overthrow of the republican constitution, as they were fond of designating the events of this day.

Opimius was willing to venture on the step which Scaevola had declined, and a new principle of constitutional law was tentatively admitted. The senate adopted these measures in words, Opimius followed them up by his arms.

In every case but one this decree had been passed against the popular party. The only legal sanction given to the exercise of the imperium sine provocatione was the acquittal of the consul Opimius in B.C. 120. But the jury which tried that case probably consisted entirely of senators, who would not stultify their own proceedings by condemning him.
