It was a significant indication of this, that the proposal to have the vacant stalls in the chief priestly colleges filled up by the burgesses instead of the colleges themselves which the government had frustrated in the comitia in 609 by the suggestion of religious scruples was carried in 650 by Gnaeus Domitius without the senate having been able even to venture a serious resistance.

Their power grew to such a height that they acquired the right of proposing to the Comitia tributa, or the Senate, measures on nearly all the important affairs of the state, and finally were elected from among the Senators themselves. These rights were only secured by bitter and fierce contests.

In legislative measures, a senatus consultum was brought before the people by the consul, or the senator who originated the measure, after it had previously been exhibited in public for seventeen days. The inferior magistrates, whose office it was to superintend affairs of local interest, were elected by the Comitia Tributa.

By skirmishes, meantime, in all of which he was superior, Marcellus gained himself such high repute, that, when the time of the Comitia at Rome was near at hand, the senate thought fit rather to recall the other consul from Sicily, than to withdraw Marcellus from his conflict with Hannibal; and on his arrival they bid him name Quintus Fulvius dictator.

There is a tradition that it had been the intention of Servius to resign the kingly honor, and to institute in its stead the office of Consul, to be jointly held by two persons chosen annually. The authority of consul was usurped by both Cinna and Marius. The consuls were elected by the comitia of the centuries.

Sometimes in difficult cases the government left the decision to the people, as first, when Caere sued for peace, after the people had declared war against it but before war had actually begun ; and at a subsequent period, when the senate hesitated to reject unceremoniously the humble entreaty of the Samnites for peace . It is not till towards the close of this epoch that we find a considerably extended intervention of the -comitia tributa- in affairs of administration, particularly through the practice of consulting it as to the conclusion of peace and of alliances: this extension probably dates from the Hortensian law of 467.

Great disorders followed, but the commons prevailed, and the Senate adopted the plebiscitum, and proposed it to the Comitia Curiata, and it became a law. This step raised the authority of the tribunes, and added to Roman liberties. He cultivated a little farm of four jugera with his own hands, and lived with great simplicity.

All of these were, in the strictest acceptation of the term, freemen. They owed to the sovereign their right hands in war; and when the exigencies of the state required, such aids in money as they themselves might vote, but without such vote, in solemn comitia granted, there was no authority anywhere to exact from them either a blade of corn, or the most minute coin of the realm.

Cato's regulations had been reversed and their vigorous author had been threatened with a tribunician prosecution before the Comitia; while Gracchus and his colleague had actually been impeached before a popular court. The reckless employment of servile labour by the companies that farmed the property of the State had already proved a danger to public security.

This was Lucius Aemilius Paullus, son of the consul of the same name that fell at Cannae; a man of the old nobility but of humble means, and therefore not so successful in the comitia as on the battle-field, where he had remarkably distinguished himself in Spain and still more so in Liguria.
