It was the very year after peace to call it that had been forced on prostrate Carthage; and you might think an exhausted Rome would have welcomed a breathing time, even at the expense of losing her annual outing. And so indeed the people were inclined to do. But the summer was icumen in; and what were consuls and Senate for? Should they be as these irresponsibles of the comitia?

There, in those waters, the proscribed met, and escaped to Numidia, and Sulla was spared the odium of putting to death his old commander, who had delivered Rome from the Cimbrians. He suggested a new series of legislative enactments in the interests of the aristocracy. He created three hundred new senators, and brought back the old Servian rule of voting in the Comitia Centuriata.

The administrative jurisdiction, which the senate exercised either of itself or, on occasion, by extraordinary commissions, over the provincial magistrates, was confessedly inadequate. An effort was made to emancipate the comitia from the predominant influence of the aristocracy.

This naturally pleased the plebeians, but was not approved by the citizens of high pedigree, who thus lost some of their prestige. In these conclaves they elected certain magistrates, gave sanction to legislative acts, and decided upon war or peace. This Comitia formed the highest court of appeal known to Roman law.

But for 699 there even appeared as candidate for the consulship Lucius Domitius Ahenobarbus, whose election it was difficult to prevent owing to his influence in the capital and his colossal wealth, and who, it was sufficiently well known, would not be content with a concealed opposition. The comitia thus rebelled; and the senate chimed in.

Many months before, he said in the senate that he would either prevent the comitia from assembling for the election of Dolabella by means of the auspices, or that he would do what he actually did do.

The address of the Consul was short, practical, and to the point; and the danger he foretold to the order was so terrible, while the inconvenience of deferring the elections was so small, and its occurrence so frequent—a sudden tempest, the striking of the standard on the Janiculum, the interruption of a tribune, or the slightest informality in the augural rites sufficing to interrupt themthat little objection was made in any quarter, to the motion of Cicero, that the comitia should be delayed, until the matter could be thoroughly investigated.

In regard to criminal courts among the Romans during the republic, the only body which had absolute power of life and death was the comitia centuriata. The senate had no jurisdiction in criminal cases, so far as Roman citizens were concerned. It was only in extraordinary emergencies that the senate, with the consuls, assumed the responsibility of inflicting summary punishment.

The revolution in particular threw away the scabbard: at the suggestion of Carbo the Roman comitia outlawed all the senators that should be found in Sulla's camp. This privilege was conceded to the plebeians by the Valerian law, but must have been possessed by the patricians from the earliest times; for Horatius, when condemned for the murder of his sister, in the reign of Tullus Hostilius, escaped by appealing to the comitia curiata.
