In the theatre, indeed, there is little distinction between them: history is legend, and legend history. The fact that Shakespeare could write a play about King John, and say nothing about Runnymede and Magna Charta, shows that that incident in constitutional history had not yet passed into popular legend.

It was surrendered to the baronial party by the King as a trust or pledge for the execution of Magna Charta, and though it was put into the hands of the Archbishop, who was technically neutral, it was from that moment the symbol of a successful rebellion, as it had already proved to be in the past and was to prove so often again.

If so, very ill would the purchase of Magna Charta have merited the deluge of blood, which was shed in order to have the body of English privileges defined by a positive written law. This charter, the inestimable monument of English freedom, so long the boast and glory of this nation, would have been at once an instrument of our servitude, and a monument of our folly, if this principle were true.
