His speed, however, was very much slackened; and though, after we had hauled in the line a little, he made an attempt to sound, he quickly returned to the surface, still more exhausted by the effort. At length we managed to get near enough to him to enable Mr Trevett to give him a thrust with his lance. Deep in it went, the monster almost leaping out of the water with the agony of the wound.
The old line of cleavage was fairly well represented by the excommunication of a member of St. John's Episcopal Church of Providence for tendering bank notes, and the expulsion of a member of the Society of the Cincinnati for a similar cause. The contest culminated in the case of Trevett vs. Weeden, 1786, which is memorable in the judicial annals of the United States.
Town-meetings were held all over the state, to discuss the situation, and how long they might have talked to no purpose none can say, when all at once the matter was brought into court. A cabinet-maker in Newport named Trevett went into a meat-market kept by one John Weeden, and selecting a joint of meat, offered paper in payment. Weeden refused to take the paper except at a heavy discount.
The court, however, did not exercise the power to which it laid claim. It merely declared a resolution of the House of Delegates invalid on the ground that it had been rejected by the Senate. This case is important only as showing that the court was then paving the way for the exercise of the power to annul acts of the legislature. The case of Trevett v.
Poor Mr Trevett was pierced through, and fell with a deep groan to the bottom of the boat; another of my companions sprung up as he was struck, and went headlong overboard; others were badly wounded; and one man only besides me was unhurt by the first shower of missiles.
We were not a little hurried in our movements by seeing two or more sharks, which had been attracted to the spot by the blood flowing from the monster; and they would just as soon have taken a meal off us as a nibble at him, which is all they would have got for some time, probably. "Never fear, my lads!" shouted Mr Trevett, the mate. "Strike out with your feet, and heave over the boat.
Trevett went to bed supperless, and next morning informed against the obstinate butcher for disobedience to the forcing act. Should the court find him guilty, it would be a good speculation for Trevett, for half of the five hundred dollars fine was to go to the informer.
